The Commission took part in the Third International Conference on safeguarding human rights through national standards for judicial education, 18 December, 2015

Mr. Sergii Koziakov, Chairman of the Commission, the Commission’s Members and representatives of the Commission Secretariat took part in the Third International Conference on safeguarding human rights through national standards for judicial education on the 5th Anniversary occasion of the National School of Judges of Ukraine, held on 18 December 2015 in Kyiv city.

The event was organized by the National School of Judges of Ukraine supported by the European Union and the Council of Europe “Strengthening the Implementation of European Human Rights Standards in Ukraine” joint Project, OSCE Project Co-ordinator in Ukraine and the Government of Canada.

In particular, the Commission has delegated Mr. Mykola Patriuk, Deputy Chairman of the Commission, Mrs. Valentyna Ustymenko and Mr. Pavlo Lutsiuk, Members of the Commission Disciplinary Chamber, Mrs. Olena Ponomarenko, Chief of the Commission Secretariat, Mr. Roman Savchuk, Director of Professional Qualification of Judges and Judicial Candidates Department of the Commission Secretariat and Mrs. Polina Kazakevych, the Head of the International Cooperation Division.

In his welcoming speech Mr. Sergii Koziakov noted the high professional level of National School of Judges of Ukraine teachers and stressed that the Commission and National School are able to conduct successfully the common tasks defined by existing legislation on the judiciary formation only upon condition of their cooperation and mutual understanding.

On behalf of the co-organizers of the event the participants of the Conference and the National School of Judges Ukraine were welcomed by           Mr. Vaidotas Verba, the Ambassador and the OSCE Project Co-ordinator in Ukraine, Mr. Roman Vashchuk, Ambassador Extraordinary and Plenipotentiary of Canada to Ukraine along with Mr. Vladimir Ristovski, the Ambassador and the Head of the Council of Europe Office in Ukraine.

“The high quality of the judicial corps is a key condition for existence of trust to judges in society and the key to successful implementation of judicial reform”, - Mr. Roman Vashchuk, the Ambassador of Canada to Ukraine, noted and thanked the National School of Judges of Ukraine for openness to new ideas.

Mr. Vladimir Ristovski, the Ambassador and Head of the Council of Europe Office in Ukraine, expressed his hope that the development of judicial education in Ukraine will remain in sight of the Council of Europe and reassured that technical and other assistance would be provided henceforth.

Mr. Kostiantyn Krasovsky, Head of the Main Department on Legal Policy of the Presidential Administration of Ukraine, read out the greetings of Mr. Petro Poroshenko, the President of Ukraine, which, in particular, noted that “the reform of the judicature, the judiciary and related legal institutions provides the establishment of such education system of judges, which will stimulate the growth of the professional level of a judge and his/her comprehensive progress.”

Mr. Oleksandr Paseniuk, the judge of the Constitutional Court of Ukraine read out the greetings and delivered award from Mr. Yurii Baulin, Chairman of the Constitutional Court of Ukraine to Mr. Mykola Onishchuk, Rector of the National School of Judges of Ukraine.

Furthermore, welcoming speech was made by Mr. Yaroslav Romaniuk, President of the Supreme Court of Ukraine, Mr. Oleksandr Nechytailo, Head of the Supreme Administrative Court of Ukraine, Mr. Bohdan Lvov, Chairman of the Supreme Commercial Court of Ukraine, Mr. Zenovii Holodniuk, Head of the State Judicial Administration of Ukraine and Mrs. Valentyna Simonenko, Chairman of the Council of Judges of Ukraine.

Within the report, Mr. Mykola Onishchuk, Rector of the National School of Judges of Ukraine, outlined the current state of education of judges of Ukraine and prospects of its development. Apart from that, Mr. Onishchuk has paid particular attention to working activities of the National School of Judges of Ukraine in the candidate’s selection process to the position of a judge. In particular, he stressed that due to the 5 year's efforts of the National School of Judges of Ukraine there were developed 4,000 tests and 500 situational queries for the competitive selection on the position of a judge.

Mr. Mykola Patriuk, Deputy Chairman and Chairman of the Disciplinary Chamber of the Commission, made a report on “Compliance with judicial discipline standards as a criterion of proper qualification level of a judge” and elaborated on the issues raised during consideration of complaints about judicial misconduct.

International experts from Canada, Poland, Lithuania, Georgia and UK have acquainted Conference participants with the standards of judicial education in other countries. 

The event was also participated by the European Court of Human Rights acting judges: Mrs. Angelika Nussberger, President (Section V) (Germany), Mrs. Ganna Yudkivska, Vice-President (Section V) (Ukraine) and Mr. Dragoljub Popović, retired judge of the European Court of Human Rights (Serbia).

During the Conference, Mr. Lasha Magradze, Director of the High School of Justice of Georgia has signed Cooperation Agreement with Mr. Mykola Onishchuk, Rector of the National School of Judges of Ukraine.
