For the attention of judges who appealed statements to the High Qualification Commission of Judges of Ukraine on transferring to another court.
The Law of Ukraine "On the right to a fair trial" went into effect on March 29, 2015.
According to the Paragraph 15 of Section II Final and transitional provisions of the Act as primary measures the Commission should conduct a 90-day competition for candidates for the post of judge for the first time, admitted to the reserve and within three years after the transfer to the reserve not applied for the contest to occupy the vacant post of judge, in which the end of that three-year period occurred in the period from 11 April through 31 December 2014.
The term for such competition determinate by the provisions of the Law of Ukraine "On the right to a fair trial," and so this competition will be conducted by the Commission during May through June 2015.
Also one of the primary activities of the Commission is recommending for election as a judge appointed for an unlimited term, who submitted to the Commission at the time of entry into force of the aforementioned Law, the application for election as a judge for an unlimited term and evaluation of their qualification.
As to term of issues considered by the Commission to recommend judges to transfer to another court, announce that under the First, Second Part of Article 75 and First Part of Article 82 of the Law of Ukraine "On the Judicial System" transfer of judges to another court within the period of five years and judges appointed for an unlimited term, carried out by the results of the competition for the vacant position of a judge in the manner specified by Article 73 of the Law.
The High Qualification Commission of Judges of Ukraine decided to hold the competition to occupy the vacant positions of judges, the announcement will be placed on the official web site of the Commission not later than one month before the day of the competition.
The Commission will conduct the competition on the post of judge among the judges within the period of five years and judges appointed for an unlimited term during June - July 2015.
