Commission informs about suspension of initial qualification assessment for the appellate judges of Kyiv and Kyiv region, who submitted to the High Council of Justice letters of their resignation
On 22 March 2016 the Commission took a decision to hold during April-June 2016 the initial qualification assessment of appellate court judges and approved the list of judges who will pass the assessment, schedule for initial qualification assessment, and list of tasks for anonymous written test.
Paragraph 5.9 of the Procedure and Methodology for Qualification Assessment of Judges (hereinafter the “Procedure”) approved by the High Qualification Commission of Judges of Ukraine (hereinafter the “Commission”) Decision № 67/zp-15 as of 21 October 2015 and agreed by the Council of Judges of Ukraine Decision № 14 as of 11 December 2015, provides that before the initial qualification assessment and at any stage of initial qualification assessment judge has the right to submit to the High Council of Justice (hereinafter the “Council”) letter of resignation or resignation notice in accordance with Article 120 of the Law of Ukraine “On Judiciary and the Status of Judges” (hereinafter the “Law”). In this case, qualification assessment of the judge shall be suspended.
Bearing in mind facts mentioned above and the Articles 83-86, 101, 102 of the Law and Procedure, to comply with these legal rules on holding of initial qualification assessment, on 1 April 2016 the Commission decided to suspend the initial qualification assessment of appellate court judges of Kyiv and Kyiv region, who submitted to the Council their letters of resignation:
- Mrs. Valentyna Antonenko, judge of Appeal Court of Kyiv region;
- Mrs. Nataliia Vorobiova, judge of Appeal Court of Kyiv region;
- Mrs. Liubov Datsenko, judge of Appeal Court of Kyiv region;
- Mr. Viktor Dymaretsko, judge of Appeal Court of Kyiv region;
- Mrs. Nataliia Kolokolnikova, judge of Appeal Court of Kyiv region;
- Mr. Oleksandr Loban, judge of Kyiv Commercial Court of Appeal;
- Mrs. Liliia Kasianenko, judge of Appeal Court of Kyiv region;
- Mr. Viktor Lashchenko, judge of Appeal Court of Kyiv region;
- Mr. Mykola Matiushko, judge of Appeal Court of Kyiv region;
- Mr. Anatolii Nahornyi, judge of Appeal Court of Kyiv region;
- Mr. Vasyl Polosenko, judge of Appeal Court of Kyiv region;
- Mr. Oleksandr Shevchenko, judge of Appeal Court of Kyiv region;
- Mrs. Lidiia Riepina, judge of Kyiv Commercial Court of Appeal;
