Competition for 35 judicial vacancies of local courts for judicial candidates who meet requirements of Section III, paragraph 13, period 3 of the Law of Ukraine “On the High Council of Justice” announced
On August 5, 2019, the High Qualification Commission of Judges of Ukraine announced a competition for 35 judicial vacancies of local courts for judicial candidates who meet the requirements of Section III, paragraph 13, period 3 of the “Final and Transitional Provisions” of the Law of Ukraine “On the High Council of Justice” and received more than 75 percent of the maximum possible score of the qualification exam, passed before the Law of Ukraine “On the Judiciary and the Status of Judges” came into force on 02 June 2016 No. 1402-VIII:
1) Kalynyvskyi District Court of Vinnytsia Region - 1 position;
2) Litynskyi District Court of Vinnytsia Region - 1 position;
3) Lutsk City District Court of Volyn Region - 2 positions;
4) Zhytomyr District Court of Zhytomyr Region - 1 position;
5) Uzhgorod City Court of Zakarpattia Region - 1 position;
6) Belotserkivskyi City District Court of Kyiv Region - 1 position;
7) Kyiv Sviatoshynskyi District Court of Kyiv Region - 1 position;
8) Boryslavskyi City Court of Lviv Region - 1 position;
9) Drohobytskyi City Court of Lviv Region - 1 position;
10) Sykhivskyi District Court of Lviv - 1 position;
11) Zhovtnevyi District Court of Poltava - 1 position;

Documents for participation in the competition shall be submitted by post at: 9, General Shapoval Str., Kyiv, 03109, Ukraine, following the Terms of conducting a competition for 35 judicial vacancies of local courts for judicial candidates who meet the requirements of Section III, paragraph 13, period 3 of the “Final and Transitional Provisions” of the Law of Ukraine “On the High Council of Justice” and received more than 75 percent of the maximum possible score of the qualification exam, passed before the Law of Ukraine “On the Judiciary and the Status of Judges” came into force on 02 June 2016 No. 1402-VIII.
Documents for participation in the competition submitted in any other way (personal submission, e-mail, etc.) shall not be accepted.
The deadline for submission of documents for participation in the competition is 1 calendar day, September 06, 2019.
The issue of admission of candidates for a special background check will be considered on September 25, 2019.
Information on the date, time and venue of the competition will be published on the Commission’s official website additionally.
Terms of conducting a competition for 35 judicial vacancies of local courts for judicial candidates who meet the requirements of Section III, paragraph 13, period 3 of the “Final and Transitional Provisions” of the Law of Ukraine “On the High Council of Justice” and received more than 75 percent of the maximum possible score of the qualification exam, passed before the Law of Ukraine “On the Judiciary and the Status of Judges” came into force on 02 June 2016 No. 1402-VIII.
1. The competition for vacant positions of judges of local courts (hereinafter referred to as “Competition”) is carried out by the High Qualification Commission of Judges of Ukraine (hereinafter referred to as “the Commission”) in accordance with Articles 69 and 79 of the Law of Ukraine “On the Judiciary and the Status of Judges” Section III, paragraph 13, period 3 of the Law of Ukraine “On the High Council of Justice” and the Regulation on conducting the competition for filling vacant judicial position, adopted by the Decision of the High Qualification Commission of Judges of Ukraine No.141/zp-16 of November 2, 2016 (with amendments, hereinafter referred to as the “Regulation”).
2. The competition was announced for 35 vacant positions of judges in local courts.
3. To take part in the competition is allowed for the persons, who:
1) have submitted all necessary documents in accordance with the procedure and conditions specified by these Terms;
2) meet the requirements of Section III, paragraph 13, period 3 of the “Final and Transitional Provisions” of the Law of Ukraine “On the High Council of Justice” and received more than 75 percent of the maximum possible score of the qualification exam, passed before the Law of Ukraine “On the Judiciary and the Status of Judges” came into force on 02 June 2016 No. 1402-VIII;
3) according to the results of a special background check, they are recognized as meeting the requirements for the judicial candidate laid down by law.
4. The term for submission of documents for participation in the competition is one calendar day, September 06, 2019.
5. Persons who sent documents to the Commission before or after August 30, 2019, are not allowed to undergo a special background check and participate in the competition.
6. Documents should be sent by post at 9, General Shapovala Str., Kyiv, 03109, within a specified period, by a recommended letter with notification and with the possibility to receive searching results through the Internet of completed operations: the date of sending, passing and receiving the recommended letter.
Documents for participation in the competition submitted in any other way (personal submission, e-mail, etc.) are not accepted.
7. For participating in the competition, the judicial candidate shall submit to the Commission:
1) A written application on participating in the competition (hereinafter referred to as “the application”) in accordance with Appendix 1 to the Terms.
2) Copy of Passport of a citizen of Ukraine;
3) Questionnaire of a judicial candidate in accordance with Appendix 4 to the Regulation;
4) motivation letter stating the motivation for being a judge;
5) declaration of family relations of judicial candidate;
6) declaration of integrity of judicial candidate;
7) copies of diplomas confirming the candidate’s higher education in Law (with appendices) issued by universities in Ukraine, copies of diplomas in Law issued by foreign universities along with copies of documents confirming recognition of such diplomas in Ukraine, as well as copies of documents confirming academic degrees (if any);
8) copy of the employment record book or service record credentials (if any) or other documents concerning the employment of a judicial candidate;
9) medical institution certificate of the established form on psychiatric and narcological examinations and registration at psychoneurological or narcological health care establishments;
10) written consent to the collection, storage, processing and use of information on the candidate for the purposes of evaluation their readiness to work on the position of a judge in accordance with Appendix 5 to the Regulation;
11) consent to a background check procedure in relation to them, in accordance with the law in accordance with Appendix 6 to the Regulation;
12) copy of the declaration of the person authorized to perform the functions of state or local self-government, covering the period of the year preceding the year of submission of documents, and a link to the relevant page of the Unified State Register of Declarations of persons authorized to perform the functions of state or local self-government;
13) copy of military card (for military personnel or obligated reservists);
14) certificate of no criminal record;
15) CD containing scanned copies of documents specified in the Terms and the candidate information in the form set out in Appendix 9 to the Regulation.
8.Documents (materials) specified in subparagraphs 2–15 of paragraph 7 of these Terms shall meet the requirements of paragraph 3.5.1 of the Regulation and shall be formulated as an Appendix to the application.
9. The repeated submissions of a person with an application to participate in the relevant competition, and/or withdrawal of such applications shall not be subject to consideration by the Commission.
10. The results of the competition shall be determined on the basis of the rating of its participants, taking into account the results of the qualification examination passed before the Law of Ukraine “On the Judiciary and the Status of Judges” of 02 June 2016 No. 1402-VIII entered into force.
11. Information on the date and time of the competition shall be published on the official website of the Commission after the issue of admission of candidates to the competition has been decided upon the results of their special background check.
