Competition for vacant positions of local courts judges by transfer of a judge to a judicial position in another court announced
The High Qualification Commission of Judges of Ukraine on August 01, 2019 announced a competition by transfer for 220 vacant judicial positions in local courts, including 150 positions in local general courts, 20 positions in local commercial courts and 50 positions in local administrative courts, for the following judges:

Documents for participation in the competition shall be submitted by post at: 9, General Shapoval Str., Kyiv, 03109, Ukraine, following the Terms of conducting a competition for vacant positions of local courts judges by transferring a judge to a judicial position in another court approved by the Commission’s decision as of August 1, 2019.
Documents for participation in the competition submitted in any other way (personal submission, e-mail, etc.) shall not be accepted.
The deadline for submission of documents for participation in the competition is 1 calendar day, August 30, 2019.
The issue of admission of candidates for participation in the competition for 220 vacant judicial positions in local courts by transfer of judges will be considered on September 25, 2019.
Information on the date, time and venue of the competition will be published on the Commission’s official website additionally.
Terms of conducting the competition for filling vacant positions of local court judges by transferring a judge to a judicial position to another court
1. The competition for vacant positions of judges of local courts by transferring a judge to the judicial position to another court (hereinafter referred to as “Competition”) is carried out by the High Qualification Commission of Judges of Ukraine (hereinafter referred to as “the Commission”) in accordance with Articles 79 and 82 of the Law of Ukraine “On the Judiciary and the Status of Judges” and the Regulation on conducting the competition for filling vacant judicial position, adopted by the Decision of the High Qualification Commission of Judges of Ukraine No.141/zp-16 of November 2, 2016 (with amendments, hereinafter referred to as the “Regulations”).
2. The competition was announced for 220 vacant positions of judges in local courts including:
- 150 positions in local general courts;
- 50 positions in local administrative courts;
- 20 positions in local commercial courts.
3. To take part in the competition is allowed for the candidates, who are judges on the day of submission of documents and who hold the position for a lifetime term or whose term of office has not expired and who have indicated their intention to be transferred to the judicial position in a local general, local administrative or local commercial court, and who:
1) correspond to the judicial position according to the results of the qualification evaluation for the compliance with the judicial position held, in particular have confirmed the ability to administer justice in the respective court according to the results of the qualification evaluation within the respective competition, if according to the results of competition the judge is considered to have confirmed the compliance with the judicial position held, or have confirmed the ability to administer justice in the respective court in accordance with Section XII, paragraph 21 of the Law, in the event of a simultaneous application to the Commission on conducting the qualification evaluation for participating in the competition;
2) have submitted all necessary documents in accordance with the procedure and conditions specified by these Terms.
4. The term for submission of documents for participation in the competition is one calendar day, August 30, 2019.
5. Persons who sent documents to the Commission before or after August 30, 2019, are not allowed to participate in the competition.
6. Documents should be sent by post at 9, General Shapovala Str., Kyiv, 03109, within a specified period, by a recommended letter with notification and with the possibility to receive searching results through the Internet of completed operations: the date of sending, passing and receiving the recommended letter.
Documents for participation in the competition in any other way (personal submission, e-mail, etc.) are not accepted.
7. For participating in the competition, the judicial candidate shall submit to the Commission:
1) A written application on participating in the competition (hereinafter referred to as “the application”) in accordance with Appendix 1 to the Terms.
The number of courts with a request for recommendations to which the candidate may apply shall not exceed 5 courts.
If a candidate intends to apply for a vacant position of a judge at 2, 3, 4 or 5 courts, he/she must indicate such courts in the application for participation in the competition in accordance with the priority of the intention of a candidate on its taking from 1 to 5 on relevant specialization, where 1 is the court with the highest priority, 5 – with the lowest priority.
2) A written application on conducting the qualification evaluation for participation in the competition in accordance with Appendix 2 to the Terms (in case the submission is obligatory or the wish has been expressed (subparagraph 8.1 of paragraph 8 of these Terms));
3) A written application on inclusion to the rating of participants of the competition of the results of the last qualification evaluation in accordance with Appendix 2 to the Terms (if the wish has been expressed (subparagraph 8.2 of paragraph 8 of these Terms));
4) Copy of Passport of a citizen of Ukraine;
5) Questionnaire of a judicial candidate in accordance with Appendix 4 to the Regulation;
6) CD with scanned copies of the documents specified by the Terms.
8. A candidate may submit only one application for participation in the competition and for one specialization only.
Documents (materials) specified in subparagraphs 2–6 of paragraph 7 of these Terms shall meet the requirements of paragraph 3.5 of the Regulation and shall be formulated as an Appendix to the application.
The application and the documents attached thereto shall not be subject to return.
Repeated application of the person for participation in the competition is not allowed, in particular, if the application has been withdrawn within the announced competition.
8.1. The application on conducting the qualification evaluation for participation in the competition shall be submitted according to the same specialization as stated in the application for participation in the competition.
An application on conducting the qualification evaluation for participation in the competition must be submitted by candidates who are judges who have confirmed their ability to administer justice in a respective court in accordance with paragraph 21 of Section XII of the Law, and judges who have expressed their intention to be transferred to the position of a local general court judge, a local administrative or local commercial court judge as a lower instance court or other specialization.
The application on conducting the qualification evaluation for participation in the competition in case of a wish shall be submitted by candidates, if one year has passed since the decision of the Commission on the results of the last qualification evaluation of that candidate was adopted.
8.2. The application for inclusion to the rating of the participants of the competition of the results of the last qualification evaluation according to Appendix 3 to the Terms in case of a wish shall be submitted by candidates who, after having been recognized by the Commission as correspondent to the judicial position held in the framework of the qualification evaluation process for compliance with the judicial position held, participated in competitions for vacant judicial position under a special appointment procedure, provided that they confirm their ability to administer justice in the appropriate court in the respective court on the appropriate specialization and wish to use their examination score received during the last qualification evaluation within the relevant competition.
8.3. All obligatory sections, as well as section II (information on work as a judge), if the candidate has a scientific degree – section III (information on scientific degree and work experience in the field of law) shall be filled in the questionnaire of the candidate for the position of a judge.
9. The repeated submissions of a person with an application to participate in the relevant competition, applications indicating the priority of the candidate’s intention to replace the position in the courts of various specializations, as well as the applications of a person who has submitted more than one application for participation in the competition shall not be not subject to consideration by the Commission.
Applications on inclusion to the rating of the participants of the competition of the results of the last qualification evaluation, in which the person expressed a wish to credit the points he/she obtained at the examination during the qualification evaluation within several competitions or the points obtained on the results of the examination during the qualification evaluation within the relevant competition, which is not the last for such a judge shall not be subject to consideration by the Commission.
10. Determination of the competition results is carried out on the basis of formed and approved by the Commission participants’ rating.
The rating of participants of the competition is formed for each court separately according to the results of processing the applications of candidates for participation in the competition, taking into account the number of points scored on the results of their exams within the qualification evaluation procedure.
The rating of the participants of the competition is formed taking into account the number of points scored on the results of passing the exam within the procedure of the qualification evaluation for the compliance with the judicial position held, including the procedure of qualification evaluation within the relevant competition, if according to its results the judge is considered to have confirmed the compliance with the judicial position held, and within the scope of the qualification evaluation for the competition.
The score obtained according to the results of the examination within the framework of the last qualification evaluation specified in the application shall be credited to the rating of the candidates who have applied for inclusion to the rating of the participants of the competition of the results of the last qualification evaluation.
In case a candidate applied with the application for participation in the competition for vacant position of a judge in two or more courts, the rating of its participants would reflect the information on a candidate concerning that court, where he/she got a winning position, or concerning the court, which according to the priorities of his/her intentions, is the last (in case a candidate fails to receive a winning position from any of judicial posts according to the priority of his/her intentions).
In case of equal position according to the rating of the participants of the competition, preference is given to the participant who has got a higher number of points for the practical task performed during the examination within the qualification evaluation, and for the same number of points, the advantage is given to the participant who has longer experience as a judge. If the participants have the same length of service as a judge, preference is given to the participant who has a longer professional experience in the field of law.
