Due to the expiry of the time-limit the Commission is forced to discontinue disciplinary proceedings against judges

At the meeting of the High Qualification Commission of Judges of Ukraine, held on 1 December 2015, it was considering the issue of bringing judges to disciplinary liability.

After verification the Commission established the existence of offense in the actions of 11 judges, however, due to the expiry of the time-limit after violation date the Commission discontinued disciplinary proceedings against them.

Recalling that according to the Law of Ukraine “On Judiciary and the Status of Judges” as in force in 2010 disciplinary sanction shall be applied to the judge no later than one year after the date of violation. The Commission had not been working from 11 April 2014 and its new composition began its work on 9 December 2014, which means that Commission had not considering disciplinary cases for 8 months.

In addition, the Commission discontinued disciplinary cases in respect of 2 judges on the ground of absence of constituent elements of offence and in connection with resignation by 1 of judges.

The Commission applied disciplinary sanction in the form of reprimand to 1 judge.

Finally, the Commission deferred consideration of the issue on brining judges to disciplinary liability in respect of 7 judges.
