“HQCJU will provide the examination papers to the candidates to the Supreme Court upon inquiry of their authors”, Mr. Sergii Koziakov says
High Qualification Commission of Judges of Ukraine will provide a copy of the examination paper to the candidates to the Supreme Court upon their personal inquiry.
“Recently some of the civil society organizations representatives have been demanding that the HQCJU publicized the candidates' papers. A candidate could do it on their own, if they so decide, to make an inquiry and receive a copy of their work”, the Chairman of the Commission said.
Mr. Sergii Koziakov emphasized that disclosing 520 papers on the Internet would cause speculations and threats towards specific candidates. This point is further supported in the opinion of the Consultative Council of European Judges No. 17, para.48.
“When we announced the conditions before the competition start, we did not warn the candidates on possible publication of their papers. Doing it now would mean changing the conditions halfway the process of competition. We should respect not only the situation of those participants who completed the competition but also those who are going through it”, the Chairman of the Commission believes.
Mr. Sergii Koziakov emphasized that “professional capacities of the candidates are assessed only by the members of the High Qualification Commission of Judges of Ukraine under the methodology developed by the experts of the EU Project “Support to Justice Sector Reform in Ukraine”. “Publicizing the papers on the Web would only fuel another round of discussions and comparisons based on subjective attitudes rather than objective judgment”, he highlighted.
The Chairman of the Commission reminded that the Public Council of Integrity was established to support the High Qualification Commission of Judges to check the compliance (of a judicial candidate) with the professional ethics and integrity criteria for the purpose of qualification assessment (Art. 87 of the Law of Ukraine “On the Judiciary and the Status of Judges”).
“We expect the PCI to deliver grounded opinions on the candidates' integrity and professional ethics. By the way, any person may assist both the PCI and the HQCJU in this matter by providing information known to them and analyzing the candidates' dossiers posted on the official website of the Commission”, Mr. Sergii Koziakov added.
