“I support the efforts on establishment of Anti-Сorruption Сourt” - Mr. Sergii Koziakov
On 27th of September 2017, the Chairman of the High Qualification Commission of Judges of Ukraine Mr. Sergii Koziakov took part in an expert discussion on the assessment of corruption risks in the judiciary and creation of Anti-Сorruption Сourt.
The wide discussion included the participation of the National Anti-Corruption Bureau of Ukraine Director Mr. Artem Sytnyk, People’s Deputies of Ukraine Mr. Yegor Sobolev, Mr. Sergii Leshchenko and Ms. Svitlana Zalishchiuk, member of the Public Integrity Council Mr. Roman Kuibida, experts Mr. Alexander Vodyannikov, Mr. Markian Halabala and others.
According to the Chairman of the Commission, prior to discussing the establishment of
Anti-Corruption Court, it is vitally important to wait for the opinion of the Venice Commission on the draft law in this regard. After that, it is necessary to finalize all legal acts in order to have a clear understanding of how to implement the law in the future.
“I support the creation of a court that will deal with corruption cases. This should be done quickly and professionally” - said Mr. Sergii Koziakov.
It is important to learn the experience of other countries in the selection procedure of judges to Anti-Corruption Courts since corruption cases should be considered by judges who have passed the qualification assessment procedure, - said the Chairman of the Commission.
Mr. Sergii Koziakov stressed the need to analyze the positive and negative results of the procedure used by the High Qualification Commission of Judges of Ukraine during the competition for the position of a judge to the Supreme Court. This experience will be useful in the formation of an Anti-Corruption Court.
As Mr. Sergii Koziakov noted, it is also important to determine who will conduct the qualification assessment for judges who will deal with anti-corruption cases. If it is the High Qualification Commission of Judges of Ukraine, then it is necessary to find out, whether it will be able to conduct the selection of candidates for local judges at the same time, qualification assessment of all other judges and the rest of necessary procedures.
Expert discussion “Perception of corruption and assessment of corruption risks in the judicial system. An effective solution to the problem – the establishing of an Anti-Corruption Court?” was provided by the Ukrainian representative office of Transparency International, with the support of USAID “New Justice” Program and the Ministry of Foreign Affairs of the Czech Republic under the Transition Promotion Program.
