Information regarding the recommendation of the High Qualification Commission of Judges of Ukraine to elect Mrs Iryna Yukhno and Mr Oleksii Rudiuk for the post of judge for a lifetime term
In connection to the news in the mass media of Ukraine regarding the preparing by the High Qualification Commission of Judges of Ukraine of the documents in respect of judges Mrs Iryna Yukhno and Mr Oleksii Rudiuk, the Commission reports the following.
According to Article 19 of the Consitution of Ukraine, public authorities and organs of local self-government, their public servants are under an obligation to operate only on foundation, within the limits of plenary powers and in a method, that is foreseen by Constitution and laws of Ukraine.
According to Article 128 of the Constitution of Ukraine, the first setting on position of professional judge for a term of five years is carried out by President of Ukraine. All other judges, except for the judges of Constitutional Court of Ukraine, are elected by Parliament of Ukraine permanently, in the order set by a law.
Under Article 91 of the Law of Ukraine on Judiciary and Status of Judges in the version that was in force until 28 March 2015, providing recommendations on the election for a lifetime judicial position was referred to the competence of High Qualification Commission of Judges of Ukraine.
At the moment of consideration by the Commission of question on recommending candidates Mrs Iryna Yukhno and Mr Oleksii Rudiuk for election to a lifetime judicial position, the order of election for a lifetime judicial position, set by the requirements of Article 74 of the Law and the Regulations of the Parliament of Ukraine, was in force.
