Representatives of the HQCJ learned the experience of The Federal Republic of Germany regarding the procedure of establishment and functioning of the specialized court on intellectual property.

On 11-14 December 2017, a working visit of the High Qualification Commission of Judges of Ukraine delegation to The Federal Republic of Germany took place.

The visit on: “Intellectual property protection system / procedure of selection and appointment of judges”, organized by the German Foundation for International Legal Cooperation within the framework of the Federal Government of Germany program was aimed to support legal statehood in Ukraine with a view to transferring German experience in the establishment of the Federal Patent Court and the formation of the intellectual property protection system.

The delegation included: Ms. Valentina Ustimenko, acting Deputy Head of the Comission, the member of the Chamber for Selection and Public Service of Judges, Ms. Anastasia Zaritska, Mr. Andriy Kozlov, Mr. Sergiy Prilipko, members of the Chamber for Selection and Public Service of Judges, Mr. Taras Neshyk, Director of Judicial Career Department of the Commission’s Secretariat.

During the working visit the delegation visited the High Court of Justice in Munich, where the participants had the opportunity to communicate with their European counterparts on the procedure of selecting of judges to general courts.

The following day the members of the delegation have become acquainted with the activities of the Land Court in Munich. The peculiarities of investigation of cases on intellectual property in Germany, in particular the sequence of instances, were discussed.

Moreover, the Commission’s delegation visited the European Patent Office, where Ukrainian guests learned the legal framework of the intellectual property protection in Germany.

The program of the visit envisaged professional communication in the Federal Patent Court. In particular, the members of the delegation took part in the hearing of the case on the recognition of the patent invalid.

Given that on 30th September 2017 the High Qualification Commission of Judges of Ukraine announced the competition to the High Court on Intellectual Property, the experience achieved during the trip will be extremely useful and relevant.
