The 31st plenary meeting of the European Commission for the Efficiency of Justice (CEPEJ) is taking place in Strasbourg

On 3 and 4 December, 2018 the 31st plenary meeting of the European Commission for the Efficiency of Justice (CEPEJ) is taking place, attended by Mr. Sergii Koziakov, CEPEJ member from Ukraine, Chairman of the High Qualification Commission of Judges of Ukraine.

The first day of the meeting is dedicated to discussing the evaluation of the functioning of the CEPEJ Member States court systems, the annual evaluation of EU justice systems within the framework of cooperation between the CEPEJ and the EU, recommendations for the communication of courts’ and public prosecutor’s services with the public and the media.

Particular attention is paid to presenting recent significant changes in the field of legal proceedings taking place in the Council of Europe Member States.

Mr. Sergii Koziakov, Chairman of the HQCJU informed the international community of the work carried out by the Commission for renewing the judiciary. In particular, he told about the competitions to the High Anti-Corruption Court, to the High Court on Intellectual Property, the second competition to the Supreme Court as well as about the results of qualification evaluation of judges as to their compliance with the position held.

“In one month, we conducted 3 huge examinations in the framework of the competitions: to the Supreme Court, to the High Anti-Corruption Court and the High Court on Intellectual Property.  We have never had anything like this in the history of Ukraine”, said Mr. Sergii Koziakov.

According to Mr. Sergii Koziakov, such a large number of candidates willing to take part in competitions is an evidence that lawyers trust the procedures carried out by the Commission.

In the course of the 31st plenary meeting of the CEPEJ it is also planned to discuss and adopt European Charter that will determine the scope of using artificial intelligence in judicial systems. The Charter will become the first instrument adopted at European level in this area.

The participants of the event are also to update the Guidelines for the management of judicial time and the study on judicial delays based on the case law of the European Court of Human Rights.   

In order to promote judicial mediation, the CEPEJ will finalise several practical tools: a table of mediation performance indicators, a code of conduct for mediation centres and mediation form templates.

It should be recalled that in June 2018 Mr. Sergii Koziakov was appointed as CEPEJ member from Ukraine.

The European Commission for the Efficiency of Justice (CEPEJ) was established on September 18, 2002 in accordance with the Resolution (2002) 12 of the Committee of Ministers of the Council of Europe.  This is an expert organization for the efficiency of functioning of justice in the Council of Europe Member states. The CEPEJ consists of 47 member states of the Council of Europe. The purpose of the CEPEJ’s activities is to increase the efficiency of judicial authorities of states as well as to create more effective legal documents adopted by the Council of Europe.

It is the initiator of many studies in this area, in particular, of a comparative nature. It prepares draft recommendations aimed at identifying opportunities and promoting the use of a variety of tools to combine the two key principles of justice: equity and efficiency.
