The Commission appeals to the State Judicial Administration of Ukraine and to the Council of Judges of Ukraine to strengthen control over the proper performance of local courts Staff Chiefs’ duties on judicial dossier filling
During conducting by the High Qualification Commission of Judges of Ukraine (hereinafter – the Commission) of initial qualification assessment of judges, who applied for the lifetime judicial position, it found numerous cases of improper performance of local courts Staff Chiefs’ duties on filling judicial dossiers with information on judges provided by Regulation on Procedure of Maintenance of Judicial Dossier, timely data direction to the Commission's requests etc. Regular appeals of the Commission by sending requests to obtain impartial information not always are processed on time and properly responded by the courts side.
Such facts make difficult and impossible the conducting of objective assessment of judges and forcing the Commission to declare a break in determining the results of the initial qualification assessment of judges in order to obtain reliable data on the judges’ performance indicators.
To prevent such cases and to secure a common approach to qualification assessment of judges, the Commission requested the State Judicial Administration of Ukraine and Council of Judges of Ukraine to strengthen control over the proper performance of local courts Staff Chiefs’ duties, bringing the perpetrators to responsibility and unifying the procedure for filling judicial dossier with proper information.
