The draft Law of Ukraine “On Mediation” was discussed at a regular meeting of representatives of international technical assistance projects on strengthening the Rule of Law
On June 3, 2020, a regular meeting of representatives of international technical assistance projects in the area of strengthening the Rule of Law organized within online mode by the USAID New Justice Program took place.
During the meeting, Oleksandr Oliinyk, Director of the Directorate of Justice and Criminal Justice of the Ministry of Justice of Ukraine, spoke about the efforts to develop a regulatory framework for mediation in Ukraine in the light of the draft Law of Ukraine “On Mediation” (No. 3504) prepared by a Working Group of the Ministry of Justice of Ukraine and registered in the Parliament on May 19 current year.
The draft law is designed to enshrine at the legislative level the possibility of conducting a mediation procedure, which will be based on voluntary out-of-court dispute settlement through negotiations between its parties with the help of a mediator. Individuals and legal entities will be able to apply to a mediator for mediation both before going to court and during court proceedings or the execution of court decision.
If the law is adopted, judges will be able to establish the mediability of the dispute and inform the parties on the benefits and procedure for applying to a mediator. According to experts, it could reduce the workload of the judiciary and provide more effective judicial protection.
Luiza Romanadze, President of the Ukrainian Academy of Mediation, also addressed the participants at the event. She spoke about the preconditions and further steps of the adoption of the draft Law of Ukraine “On Mediation”, as well as the training of mediators, self-government and cooperation with public authorities.
During the meeting the High Qualification Commission of Judges of Ukraine was represented by Oleksandra Hunchenko, Head Specialist of the Legal and Normative Work Division of the Legal Department of the Commission’s Secretariat.
