The High Qualification Commission of Judges of Ukraine appeals to the courts on proper compliance with the Law of Ukraine “On Judiciary and the Status of Judges” and on timely response to the Commission's requests
Within the frameworks of preparations to the initial qualification assessment of judges, who have submitted the applications on the election to the lifetime judge positions by the moment of entering into force the Law of Ukraine “On ensuring the right to a fair trial” (hereinafter – the Law), on 28 December 2015 the High Qualification Commission of Judges of Ukraine has forwarded its requests on providing within 10 days, in case of availability, the information on determination of each judge' specialization and also duly certified copies of meetings decisions of judges which confirmed this information. Such information is necessary to meet the order requirements agreed by the Council of Judges of Ukraine and methodology of the qualification assessment of a judge with taking into account the specialization of judges.
As of 11 January 2016 the information on the specialization of judges’ determination and duly certified copies of judges' meetings decisions that confirm such information was not provided to the High Qualification Commission of Judges of Ukraine, except two courts.
According to paragraph 2 of the Article 101 of the Law of Ukraine “On the Judiciary and the Status of Judges”, the High Qualification Commission of Judges of Ukraine in order to perform its powers is entitled to request and receive necessary information from judges, the State Judicial Administration of Ukraine, judicial self-government and other judicial bodies, public authorities and local self-governments and their officials, enterprises, institutions and organizations irrespective of the ownership and subordination, NGOs and individuals, which failure to provide rise statutory responsibility.
The High Qualification Commission of Judges of Ukraine draws attention to the need of compliance by the courts with the Article 101 of the Law of Ukraine “On the Judiciary and the Status of Judges” and timely response for securement of proper designing and organization of initial qualification assessment of judges.
