The Parliament adopted resolutions on Commission’s recommending the dismissal of Crimean judges
The Parliament of Ukraine adopted the Resolution (№3823-№3823-192), which is expected to dismiss 193 judges from the Autonomous Republic of Crimea (ARC) and Sevastopol city in connection with violation of oath.
We are recalling that in 2015 the Commission received the appeal of Mr. Anatolii Matios, Deputy Prosecutor-General of Ukraine, Mr. Serhii Leshchenko, People’s Deputy of Ukraine, Mr. Yaroslav Romaniuk, President of the Supreme Court of Ukraine, which raised the question of brining 283 judges from the Crimea to disciplinary responsibility.
By the Commission Decision as of 5 October 2015 № 2430/dp-15 the disciplinary case upon the foregoing appeals was opened in respect of 283 judges of the ARC.
On 10 November 2015 at the meeting of the Disciplinary Chamber of the High Qualification Commission of Judges of Ukraine it decided to recommend to the High Council of Justice dismissing of 283 judges.
Upon results of considering recommendation to dismiss Crimean judges for oath violation, made by the Commission, on 24 December 2015 the High Council of Judges took a Decision №1206/0/15-15 on filing a submission to the Parliament of Ukraine regarding dismissing the respective judges.
By the Ukraine Presidential Decree № 28/2016 as of 30 January 2016 in accordance with subparagraph 5 of paragraph 5 of the Article 126 of the Constitution of Ukraine 83 judges were dismissed for oath violation.
