The peculiarities of the assessment of judges and competition for occupying a position of judge in Supreme Court of Portugal
The High Qualification Commission of Judges of Ukraine continues to hold regular meetings with judges and experts from different countries, who inform about the procedures of the assessment of judges, applied in their countries.
Today, on 21 July 2016, the members of the Commission held a video-conference with the Vice-President of the Supreme Court of Portugal.
Chairman of the Commission shared the information about the judicial reforms, which are taking place in Ukraine, with the counterpart from Portugal
He noted that the new composition of the Supreme Court of Ukraine would be formed soon, the candidates to which would be selected by the Commission according to the authority.
It’s very important for the High Qualification Commission of Judges of Ukraine to gain european experience on the relevant issues.
Members of the Commission had an opportunity to obtain knowledge about the above procedures in Portugal.
The Supreme Court of Portugal consists of 3 Chambers – civil, criminal and social and it is composed of 62 judges.
Every three years Supreme judicial council announces a competition for Supreme Court positions. Judges of appeal courts, prosecutors and scientists can take part in the competition.
The Supreme Court is mostly composed by judges.
Special selection jury assesses judges, forming three separate rating lists of judges, prosecutors and scientists which are not comparable.
The assessment of a candidate includes the verification of information about his decision, if the candidate is a judge – his reputation. A scientist can be asked, for example, about the theme of his thesis.
A candidate should have no history of being brought to disciplinary responsibility.
As a rule, a candidate for a judge position in the Supreme Court of Portugal is a person of 50-60 y.o., prosecutors or scientists are younger, but they must have not less than 20 year's legal experience.
A Supreme Court judge in Portugal can occupy the post till the age of 70.
