Training for inspectors

The two-day training for inspectors of the High Qualification Commission of Judges of Ukraine on a topic: “INSPECTOR’S WORK ON JUDICIAL PERFORMANCE EVALUATION AND DISCIPLINARY PROCEEDINGS AGAINST THE JUDGE” has started on 18 September, 2015.

The event was organized with the support of USAID FAIR Justice Project to train the inspectors of interaction skills and collaboration with colleagues, communication and self-organization, as well as the ability to write legal documents and hold interviews with judges.

During the training, participants will learn about methods and tools for holding the qualification assessment of judges and improve the professional competence for analyzing complaints (applications) on behavior of judges and inspection of the facts within the disciplinary offense.

Mr Mykola Mishyn, Member of the High Qualification Commission of Judges of Ukraine opened the training with a welcoming speech and expressed confidence that the event will be a discussion platform for the exchange of experience and knowledge on important achievements in qualification assessment and disciplinary proceedings against judges.

During the first session, participants had the opportunity to learn about European standards of professional assessment of judges’ work and the High Council of Judges of Portugal experience. Mr Artur Dionísio Oliveira, Chief Judge of the Court of Braga (Portugal), former member of the Portuguese High Council of Judges and Mr Oleksandr Serdiuk, expert of USAID FAIR Justice Project, Director of the Analytical Center at the Institute of Applied Humanitarian Research (Kharkiv), Doctor of Law and Mrs Lidiia Moskvych, Professor of Yaroslav Mudryi National Law University (Kharkiv) told training participants about criteria and methods of judicial dossier evaluation and taught skills of drafting conclusions on results of judicial information evaluation during the qualification assessment.

During the second training session Mr Serhii Mudruk, Expert of the USAID FAIR Justice Project, President of the International NGO “Universal Examination Network” told about the formalization methods of holistic assessment and examples of practical tasks assessment as part of the qualification examination.

The participants devoted much time to disciplinary practices against the judge. In particular, during the third session they received practical advices of foreign experts Mr Richard Hyde, Chief Investigator, Georgia Judicial Qualifications Commission, USA and Mr José Manuel Cardoso, Judge of the Court of Appeal of Lisbon Judicial District, former Head of the Vice-President Cabinet of the High Council of Judges of Portugal, former member of the High Council of Judges of Portugal on checking for eligibility of individual complaints concerning judicial behavior. In addition, coaches also helped the participants to develop skills for drafting conclusions on grounds for bringing judges to disciplinary liability and for establishing the facts of disciplinary offense.

The fourth session was devoted to improve the participants’ skills in investigating judicial misconduct and drafting decisions on holding judges liable for disciplinary misconduct. Moreover, the attention was paid to instruments for execution of selected disciplinary sanctions, including temporary suspension of judge from administration of justice and transfer to the lower court.
