There was a second meeting of the working group and a round table within a framework of the Council of Europe Project «Support to reform the judicial responsibility in Ukraine», March 24, 2015

The second session of the working group of the Project «Support to reform the judicial responsibility in Ukraine» was held on March 24, 2015.

The Commission together with other international partners of the Project of European judicial and executive power took part in the discussion of the future cooperation with the Project to achieve speedy results.

Mrs Polina Kazakevych, Head of International Cooperation Division of the Secretariat of the Commission proposed a new format of work with technical assistance of international projects, namely she proposed to create working groups in cooperation with each Project for a specific activity area.

It is assumed that the composition of these working groups include representatives of the Commission, international and national experts with experience in the relevant area, representatives of other government agencies in the judicial system and public. It is proposed that these working groups created for a specific period with projects of the continuous execution of tasks set by the Commission and the leadership of its international partners. Mostly of these working groups will based on improving existing and designated under the new legislation Commission procedures.

The support of projects mainly based on providing expert assistance in the development and in line with the new legislation local subordinate normative acts of the Commission that regulate the procedures associated with judicial career and disciplinary responsibility of judges. The developed legal and regulatory framework under the direction of the Commission should be the result of these working groups.

In the framework of cooperation with the Project «Support to reform the judicial responsibility in Ukraine» is proposed to create two working groups:

- the development of procedures for judicial discipline offenses under the Law of Ukraine «On the Judicial System and Status of Judges» of the Law of Ukraine «On The Right to a Fair Trial»;

- the preparation of amendments to the Constitution of Ukraine and other legislation, particularly in relation to the creation of a single body responsible for the formation of the judiciary.

On March 25, 2015 international experts during the round table «Implementation of general measures of the European Court of Human Rights Olexandr Volkov v. Ukraine» presented the findings and recommendations of the Council of Europe on judicial reform, and the recent opinion of the Venice Commission. Participants of the meeting discussed the implementation of the decisions of the European Court of Human Rights in the case «Olexandr Volkov against Ukraine» and the group of cases «Salov v. Ukraine». The participants exchanged views on the new Ukrainian legislation and subsequent implementation plan of the Project.

Council of Europe Office in Ukraine these days gathered participants and guests of Ukraine and Europe, including the Judges of the Supreme Court of Ukraine, the Supreme Administrative Court of Ukraine, the representatives of the Ministry of Justice of Ukraine, the Office of the Government Agent before the European Court of Human Rights, the High Council of Justice, the National School Judges of Ukraine, Centre for Political and Legal Reforms and representatives of the Council of Europe on Justice and Legal Cooperation.

In fact this year the High Qualification Commission of Judges of Ukraine started cooperation with the Council of Europe Project «Support to reform the judicial responsibility in Ukraine». The Project aims to improve the regulatory and disciplinary procedures of the system of justice of Ukraine.
