91 judges have not confirmed their compliance with the occupied position
The HQCJ continues to conduct the qualification evaluation of the judicial corps of Ukraine. 2969 judges in two groups of 999 and 1970 judges are undergoing the evaluation. As of 7th June 2018, the evaluation of 868 judges, subjected to the evaluation, has been completed.
Among them, 709 judges have been found to be in compliance with the occupied position and continue to hold their judicial positions.
Other 159 judges are subject to dismissal or have already been released, in particular:
- 68 judges resigned on their own during the evaluation procedure;
- 91 judges did not confirm their compliance with the position, namely: 65 judges did not pass the exam, 26 judges did not pass the interviews with Commission’s members.
“These results have become unexpected, even for us, for two reasons. First of all, because of the impressive number of judges who did not pass the exam. As it is the check of their professional knowledge and skills. The majority of them are first instance judges. The second surprise was the number of judges who decided to resign during the evaluation. Obviously, it means that the judiciary goes through self-purification through the qualification procedures,” commented Mr. Stanislav Shchotka, Deputy Chairman of the Commission.
We would like to draw your attention to the fact, that in the first group, the qualification evaluation procedure has not been completed with regard to 211 judges, including 112 of those, with respect to whom a break was announced, in particular, due to PIC’s opinions, which were not properly formalized. Interviews with these judges are currently being carried out.
We are recalling that the qualification evaluation for compliance with the occupied position was introduced in the framework of judicial reform for all judges of Ukraine. For the first thousand judges, the evaluation was announced on October 20, 2017, and has been lasting for 7 months. Among judges who have passed the evaluation, 181 judges are “judges appointed for the five-year term”, whose powers have expired. They have already been recommended for appointment to the High Council of Justice. This will allow the work of courts to be restored or unloaded. Currently, judges from the first group are in the final stage of the qualification evaluation – interviews and their dossier’s review. The second group of judges passed exams and is currently undergoing moral and psychological testing. The third group, with relation to which the decision was adopted on June 7, 2018, consists of 2,188 judges. They will start taking exams on July 2, 2018.
