Attention of candidates for the post of judge for the first time who applied to the High Qualification Commission of Judges of Ukraine to participate in the competition for occupation of the vacant post of judge of the local court of general jurisdiction
Among the candidates for the post of judge for the first time, 409 persons, included in the reserve list expressed a desire to participate in competition on occupying the vacant post of judge announced by the decision of the High Qualification Commission of Judges of Ukraine as of 14 May 2015.
According to Article 73 of the Law of Ukraine on the Judiciary and the Status of Judges, competition is a selection to fill a vacant post of judge by a candidate with higher rated position among other participants. If candidates have identical score, the advantage shall have the candidate who got higher points for the practical tasks executed during the relevant exam when his ability to be either a judge within the appropriate specialization or judge of a court of an appropriate instance was tested. If candidates still have identical score the advantage shall have the candidate who has the longer record of service in the field of law.
At the meeting of the Qualification Chamber of the Commission, held on 16 June 2015, 408 candidates were allowed to participate in the competition. The application of one candidate was left without consideration in connection with its submission to the Commission post the deadline. 125 candidates for the post of judge with higher rated position were defined as preliminary winners to occupy the vacant judicial position in some local courts of general jurisdiction. There were 10 candidates who had got the highest score for the practical task during the appropriate exam and had identical rating position, so they were defined the winners.
The Qualification Chamber of the Commission postponed defining the preliminary result of the competition in respect of 10 candidates including 2 candidates who compete to occupy the same vacant post of judge by the third criterion of the competition - work experience in the field of law – till it will receive information on appropriate record of service in respect of the candidates.
The result of competition selection is the Commission's decision to recommend a candidate who among the participants has higher rated position for appointment as a judge of the local court of general jurisdiction.
Recommendation on the appointment of a candidate for a post of judge is a separate decision for each candidate to recommend him to a specific position of a judge of a local court. Such decision displays objective information about candidates, including information about passing the procedure stages of the appointment of the candidate for a judicial position for the first time, defined by Article 66 of the aforementioned Law.
Please, be informed that consideration of issue on recommending to the High Council of Justice the candidates for the post of judge of local court upon competition result will begin by the Qualification Chamber of the High Qualification Commission of Judges of Ukraine on 26 June 2015.
