CEPEJ adopted a number of documents in the field of justice

With the aim to inform on current international documents in an area of justice, we announce that a number of important documents on improving the efficiency and quality of judicial work have been adopted by the European Commission for the Efficiency of Justice of the Council of Europe (CEPEJ) during its 33rd plenary session on December 5-6, 2019.

In particular, CEPEJ continues to pay close attention to the development and strengthening of the mediation in Europe. Previously, we have informed of significant developments of the organization in this area. In continuation of this activity, CEPEJ has adopted three new documents in the field of mediation: the Mediation Awareness Programme for judges, the Mediation Awareness and Training Programme for notaries, and the Training Programme for lawyers to assist clients in mediation. These training programs are intended to form a common understanding of the mechanisms of operation of this alternative dispute resolution method for representatives of the legal professions and are particularly relevant for countries where this institute is only in the process of formation. Such programs can be used to train representatives of these professions in order to further their participation in pilot mediation projects.

In addition, CEPEJ continues its work in the area of ​​artificial intelligence used in justice. In particular, within the European Ethical Charter on the use of artificial intelligence in judicial systems adopted in December 2018, the organization has developed a Preliminary feasibility study on the possible establishment of a mechanism to certify tools and services of artificial intelligence.

During the last CEPEJ plenary session, the Guidelines to improve the judge’s skills and competences, strengthen knowledge sharing and collaboration, and move beyond a culture of judicial isolation, which includes the analyzed successful experience of Member States in this matter were adopted. Also the CEPEJ Glossary and CEPEJ Action Plan for 2020-2021 were adopted.

The European Commission for the Efficiency of Justice (CEPEJ) was established on September 18, 2002 in accordance with the Resolution (2002) 12 of the Committee of Ministers of the Council of Europe.  This is an expert organization for the efficiency of functioning of justice in the Council of Europe Member states. The CEPEJ consists of 47 member states of the Council of Europe. The purpose of the CEPEJ’s activities is to increase the efficiency of judicial authorities of states as well as to create more effective legal documents adopted by the Council of Europe.

It is the initiator of many studies in this area, in particular, of a comparative nature. It prepares draft recommendations aimed at identifying opportunities and promoting the use of a variety of tools to combine the two key principles of justice: equity and efficiency.
