Commission members met with representatives of the World Intellectual Property Organization (WIPO) mission

On September 12, 2018, at the High Qualification Commission of Judges of Ukraine a working meeting of the Commission members with representatives of the World Intellectual Property Organization (WIPO), namely Mr. Oleksandr Shevchenko, Assistant Program Officer, Department for Transition and Developed Countries; Mr. Jim Kelly, Director of International Affairs, Federalist Society for Legal and Public Policy Studies and his deputy Mr. Paul Zimmerman; Mr. Bohdan Paduchak, Deputy Director of Intellectual Property Department, Ministry of Economic Development and Trade of Ukrainе; Ms. Olena Orliuk, Director of Research Institute of Intellectual Property, Doctor of Law, Professor, Academician of the National Academy of Sciences of Ukraine was held.

During the meeting, the Commission members briefed the guests on the peculiarities of the procedures carried out by the Commission, in particular: conducting the qualification evaluation of a judge for eligibility for the position occupied, the selection of candidates for the position of a judge of local courts, the transfer of judges without a competition in connection with reorganization, liquidation or suspension of the functioning of courts, secondment of judges to other courts, second competition to the Supreme Court, the competition to the High Anti-Corruption Court, the competition to the High Court on Intellectual Property, etc.

On September 29, 2017, the High Court on Intellectual Property was established by a Decree of the President of Ukraine. The State Judicial Administration of Ukraine determined the number of positions in this body, namely 21 judges.

On September 30, 2017, the High Qualification Commission of Judges of Ukraine announced the competition to the High Court on Intellectual Property.

The stages of the competition to the higher institution for consideration of cases related to intellectual property are the following: establishing the fact that persons meet the requirements of the law; conducting background check; qualification evaluation which includes testing for knowledge of law, case study, testing personal, moral and psychological qualities and general abilities, in particular interviewing with a psychologist, examining dossier and interview with the Commission, forming rating and determining winners.

Based on results of establishing the fact that individuals meet the requirements for a candidate for a position of a judge of the High Court on Intellectual Property, 219 persons were admitted to the competition. Currently 214 persons take part in the competition.

Representatives of the World Intellectual Property Organization (WIPO) mission highly appreciated measures taken by the Commission to effectively conduct the competition to the High Court of Intellectual Property and emphasized that they are ready to help judges-to-be to use best international practices in considering and resolving issues related to applying legislation in the field of law enforcement and customs authorities of Ukraine, dispute resolution, intellectual property, copyright and internet piracy, inventions and utility models, compulsory licensing and issues related to trademarks.

It should be recalled that on September 10, 2018, the Commission set the date for examination in the course of the qualification evaluation within the framework of this competition on October 03, 2018, and interviews with candidates who will successfully pass the exam are to be conducted in the fourth quarter of 2018.

On the part of the HQCJ Mr. Andrii Vasylenko, Mr. Mykhailo Makarchuk and Mr. Sergii Prylypko, members of the Commission, Ms. Yuliia Tkachenko, Acting Head of the International Cooperation Department of the Commission Secretariat and Mr. Denys Kuznetsov, Head Specialist of the International Cooperation Department of the Commission Secretariat attended the event.

The participants of the meeting agreed to cooperate within the purview of the Commission in establishing the High Court on Intellectual Property.
