Competition for 7 vacant positions of judges of local general courts of Donetsk and Luhansk Regions for candidates for the position of a judge announced
On August 5, 2019, the High Qualification Commission of Judges of Ukraine announced a competition for 7 vacant positions of judges in the local general courts of Donetsk and Luhansk Regions for candidates for the position of judge who meet the requirements of period 7, paragraph 13, Section III of Final and Transitional Provisions of the Law of Ukraine “On the High Council of Justice”:
- Volnovaskyi District Court of Donetsk Region - 1 position;
- Kramatorskyi City Court of Donetsk Region - 1 position;
- Lysychanskyi City Court of Luhansk Region - 1 position;
- Severodonetskyi City Court of Luhansk Region –1 position;
- Slovianskyi City Court of Donetsk Region - 2 positions;
- Starobilskyi District Court of Luhansk Region - 1 position.
Documents for participation in the competition shall be submitted by post at: 9, General Shapoval Str., Kyiv, 03109, Ukraine in compliance with the Terms of conducting the competition for 7 vacant judicial positions of local general courts of Donetsk and Luhansk Regions determined by the Commission’s decision dated August 5, 2019, for candidates for the position of judge who meet the requirements of period 7, paragraph 13, Section III of the Law of Ukraine “On the High Council of Justice”.
Documents for participation in the competition submitted in any other way (personal submission, e-mail, etc.) shall not be accepted.
The deadline for submission of documents for participation in the competition is 1 calendar day, September 6, 2019.
The issue of admission of candidates for a special background check will be considered on September 25, 2019.
Information on the date, time and venue of the competition will be published on the Commission’s official website additionally.
Terms of conducting the competition
for 7 vacant judicial positions
of local general courts of Donetsk and Luhansk Regions
for judicial candidates who meet the requirements of period 7, paragraph 13, Section III of the Law of Ukraine “On the High Council of Justice”
1. The competition for the vacant positions of judges of local general courts (hereinafter referred to as “Competition”) is carried out by the High Qualification Commission of Judges of Ukraine (hereinafter referred to as the “Commission”) in accordance with Articles 69 and 79 of the Law of Ukraine “On the Judiciary and the Status of Judges”, period 7, paragraph 13, Section III of the Law Of Ukraine “On the High Council of Justice” and the Regulation on conducting the competition for filling vacant judicial position, adopted by the Commission’s decision dated November 2, 2016 No. 141/zp-16 (with amendments, hereinafter referred to as the “Regulation”).
2. The competition was announced for 7 vacant judicial positions in local general courts of Donetsk and Luhansk Regions.
3. To take part in the competition is allowed for the persons, who:
1) have submitted all necessary documents in accordance with the procedure and conditions specified by these Terms;
2) meet the requirements of period 7, paragraph 13, Section III of the Law of Ukraine “On the High Council of Justice”;
3) according to the results of a special background check, they are recognized as meeting the requirements for the judicial candidate laid down by law.
4. Deadline for submission of documents for participation in the competition is 1 calendar day, September 6, 2019.
5. Persons who sent documents to the Commission before or after September 6, 2019 are not allowed to undergo a special background check and participate in the competition.
6. Documents should be sent by post at: 9, General Shapoval Str., Kyiv, 03109, Ukraine, within a specified period, by a recommended letter with notification and with the possibility to receive searching results through the Internet of completed operations: the date of sending, passing and receiving of the recommended letter.
Documents for participation in the competition submitted in any other way (personal submission, e-mail, etc.) are not accepted.
7. For participating in the competition, the judicial candidate shall submit to the Commission:
1) a written application on participation in the competition (hereinafter referred to as the “Application”) in accordance with Annex 1 to the Terms;
2) copy of passport of a citizen of Ukraine;
3) application form of the candidate for the position of judge, which contains information about him, in accordance with Annex 4 to the Terms;
4) motivation letter stating the reasons for being a judge;
5) declaration of the judicial candidate’s family relations;
6) declaration of integrity of candidate for the position of judge;
7) copies of diplomas confirming the candidate’s higher education in Law (with annexes) obtained in Ukraine, copies of diplomas of higher education in Law obtained abroad along with copies of the documents confirming their recognition in Ukraine, as well as copies of documents confirming academic degree (if any);
8) copy of the employment record book or service record credentials (if any) or other documents concerning the candidate’s employment as a judge;
9) medical institution certificate of the established form on psychiatric and narcological examinations and registration at psychoneurological or narcological health care establishments;
10) written consent to the collection, storage, processing and use of information about the candidate in order to evaluate their readiness to work as a judge in accordance with Annex 5 to the Regulation;
11) consent to a background check procedure in relation to them in accordance with Annex 6 to the Regulation;
12) copy of the declaration of the person authorized to perform the functions of state or local self-government, covering the period of the year preceding the year of submission of documents, and a link to the relevant page of the Unified State Register of the declarations of persons authorized to perform the functions of state or local self-government;
13) copy of the military card (for military personnel or obligated reservists);
14) certificate of no criminal record;
15) CD with scanned copies of documents specified in the Terms and the candidate information in the form set out in Annex 9 to the Regulation.
8. Documents (materials) specified in subparagraphs 2-15 of paragraph 7 of these Terms shall meet the requirements of paragraph 3.5.1 of the Regulation and shall be formulated as an Annex to the application.
9. Repeated submission of a person with an application to participate in the relevant competition, and/or withdrawal of such applications shall not be considered by the Commission.
10. The results of the competition shall be determined on the basis of the rating of its participants, taking into account the results of the qualification exam which was passed before the Law of Ukraine “On the Judiciary and the Status of Judges” dated June, 2, 2016, No. 1402-VIII came into force.
11. Information on the date and time of the competition shall be published on the official website of the Commission after the issue of admission of candidates to the competition has been decided upon the results of their special background check.
