Documents for participation in the competition for vacant positions of judges of local general courts shall be submitted by judicial candidate by post at: 9, General Shapoval Str., Kyiv, 03109, Ukraine, following the Terms of conducting the competition for vacant positions of judges of local general courts approved by the Commission’s decision as of July 2, 2019.

Documents for participation in the competition submitted in any other way (personal submission, e-mail, etc.) shall not be accepted.

The deadline for submission of documents for participation in the competition is 1 calendar day, July 12, 2019.

The issue of admission of candidates for participation in the competition will be considered on July 19, 2019.

The competition for 505 vacant positions of judges in local general courts will be held at 09:30 am, on August 7, 2019, at Commission’s premises at the following address: 9, General Shapoval Str., Kyiv, 03109, Ukraine.


Terms of the competition 
for vacant positions of judges of local general courts

 

1. The competition for vacant positions of judges of local general courts (hereinafter referred to as “Competition”) is carried out by the High Qualification Commission of Judges of Ukraine (hereinafter referred to as “the Commission”) in accordance with Articles 69, 70 and 79 of the Law of Ukraine “On the Judiciary and the Status of Judges” and the Regulation on holding the competition for filling vacant judicial office, adopted by the Decision of the High Qualification Commission of Judges of Ukraine No.141/zp-16 of November 2, 2016 (with amendments, hereinafter referred to as the “Regulations”).

2. The competition was announced for 505 vacant positions of judges in local general courts.

3. To take part in the competition are allowed for the persons, who:

1) Have submitted all necessary documents in accordance with the procedure and conditions defined by these Terms;

2) On the day of documents submission are currently in reserve for the filling vacant positions of judges of local general courts.

4. The term for submission of documents for participation in the competition is one calendar day, July 12, 2019.

5. Persons who sent documents to the Commission before or after July 12, 2019, are not allowed to participate in the competition.

6. Documents should be sent by post at 9, General Shapovala Str., Kyiv, 03109, within a specified period, by a recommended letter with notification and with the possibility to receive searching results through the Internet of completed operations: the date of sending, passing and receiving the recommended letter.

Documents for participation in the competition in any other way (personal submission, e-mail, etc.) are not accepted.

7. For participating in the competition, the judicial candidate shall submit to the Commission:

1) A written application on participating in the competition (hereinafter referred to as “the application”) in accordance with Appendix 1 to the Terms.

The number of courts with a request for recommendations to which the candidate may apply shall not exceed 5 courts.

If a candidate intends to apply for a vacant position of a judge at 2, 3, 4 or 5 courts, he/she must indicate such courts in the application for participation in the competition in accordance with the priority of the intention of a candidate on its taking from 1 to 5, where 1 is the court with the highest priority, 5 – with the lowest priority.

2) Copy of Passport of a citizen of Ukraine;

3) Questionnaire of a judicial candidate;

4) Copy of an employment book, a track record (if any) or other documents proving the professional experience in the field of law;

5) CD with scanned copies of the documents specified by the Terms and information about the candidate in the form according to Appendix 9 to the Regulations.

8. The documents (materials) specified in subparagraphs 2-5 of paragraph 7 of these Terms shall comply with the requirements of clause 3.5.1 of Regulations and shall be formalized as an annex to the application.

9. The repeated submissions of a person with an application on participation in the relevant competition and/or requests for revocation of such applications are not subject to consideration by the Commission.

10. Determination of the competition results is carried out on the basis of formed and approved by the Commission participants’ rating.

The rating of participants of the competition is formed for each court separately according to the results of processing the applications of candidates for participation in the competition, taking into account their place in the ranking of candidates for the position of a judge of the local general court

In case a candidate applied with the application for participation in the competition for vacant position of a judge in two or more courts, the rating of its participants would reflect the information on a candidate concerning that court, where he/she got a winning position, or concerning the court, which according to the priorities of his/her intentions, is the last (in case a candidate fails to receive a winning position from any of judicial posts according to the priority of his/her intentions).

Please note, that the question of filling other vacant positions of judges will be resolved by: 

1) Transfer of judges from the courts which do not administer justice;   

2) Holding a competition among judges, candidates for a position of a judge who during the July-August 2019 will successfully pass a qualification examination or have the right to special participation in the competition (paragraph 13 of section III of the Law of Ukraine “On the High Council of Justice”).
