Despite the period of vacations the Commission is working in a stable regime
Despite the vacation period the High Qualification Commission of Judges Ukraine keeps stably serve in the manner, prescribed by the law.
Recently the number of complaints has significantly increased. During two summer months the Commission has received more than two thousand complaints (statements) about the behaviour of judges. The new Members of the Disciplinary Chamber Mr Sergii Prylypko and Pavlo Lutsiuk, who joined the Commission only in July, have already felt the increased load in work of the High Qualification Commission. Currently there are 564 and 343 disciplinary proceedings before them.
“Sometimes I receive 60 complaints per a day. That is a lot. I read each case personally. Together with inspectors we analyse them, than make requests, but it is difficult to get explanationі from the judges because of the vacation period. It takes time to check the complaint qualitatively,” Mr Lutsiuk commented.
Many appeals received by the Commission are beyond its competence. “We continue receiving complaints, which often actually are appeals or cassations. The High Qualification Commission is not a court instance. Taking into account that the Commission had not been working for almost a year, of course, the load is great for today, but we make out,” Mr Prylypko said.
In addition, the Commission Member Mr Andrii Vasylenko takes part in meetings of the Working Group of the Constitutional Commission on Justice and Related Legal Institutions. At the regular meeting, held on 3 August, the Venice Commission expert advices concerning preparation of updated version of the amendments to the Constitution of Ukraine have been worked out. In respect of justice there were considered the proposals for the formation subjects of the High Council of Judicature, the creation and liquidation of courts under the law and dismissal of judges by decision of the High Council of Judicature.
The Commission Secretariat works actively, as well. For example, the Division of Special Inspection of Judicial Candidates and Judges of the Department of Appointment, Election and Removal of Judges works with a double load. According to the Head of this Division Mr Vitalii Barskyi, bearing in mind the changed requirements of the law this year, the number of applications has increased and the terms of their overall processing has accordingly increased, as well.
