Information on the number of vacant positions the HQCJU receives from the SJA and HCJ

On August 9, 2019, the High Qualification Commission of Judges of Ukraine announced a competition for the filling of 346 judicial positions in the courts of appeal. The list of courts, as well as the number of vacancies in each of them,  was posted on the Commission’s website.

In announcing the competition, the HQCJU took into account information on vacancies in the courts of appeal of Ukraine, received from the State Judicial Administration and the High Council of Justice.

“The SJA forms the courts, including, in particular, the liquidation of courts of appeal and the establishment of courts of appeal in appellate districts. After that, the High Council of Justice sends to the High Qualification Commission of Judges information in which courts and for how many positions it is necessary to announce the competition”- says the Secretary of the Chamber of Selection and Public Service of the High Qualification Commission of Judges of Ukraine, Mykhailo Makarchiuk.

He also noted that the Commission could not amend the number of positions for which the competition had been announced and separately announce the competition in the appellate district at the location of the court.

“For example, the Commission has been approached by the Chairman of the Dniprovskyi Court of Appeal with a request that the Commission make adjustments and announce the competition only to the Dniprovskyi Court of Appeal, located in the city of Kryvyi Rih. Determining the specialization of judges in considering specific cases, resolving other issues of the court’s internal activities, including job placement, is the exclusive competence of the general meeting of court judges and exactly based on these reasons the Commission cannot resolve the issues raised in the request. At the same time, the peculiarities of the work of the Dniprovskyi Court of Appeal may be the subject of discussion with candidates for the judicial positions to this court during the interview procedure,” Mykhailo Makarchiuk emphasized.

In addition, during the announcement of the competition for vacant positions of judges of appeal courts the Commission reserved a number of judicial positions in various courts of appeal. This is due to the fact that the Commission has yet to decide on the transfer to other courts of judges from the higher specialized courts and the Supreme Court of Ukraine, which have ceased to operate.
