Mr. Sergii Koziakov addressed the participants of the I International Scientific and Practical Conference “Public Service and Administrative Proceedings: Achievements and Challenges”

On 5 and 6 July 2018, the First International Scientific and Practical Conference “Public Service and Administrative Proceedings: Achievements and Challenges” is being held at the Supreme Court premises. This event takes place at the initiative of the Supreme Court, Taras Shevchenko National University of Kyiv, the National School of Judges of Ukraine and the Center of Polish Law, and with the support of the Council of Europe Project “Supporting Ukraine in the execution of judgments of the European Court of Human Rights”, and the Canadian Judicial Reform Support Project.

The meeting is attended by judges and scholars from Ukraine, countries of Europe and Asia, representatives of state authorities of Ukraine. The conference is dedicated to the anniversary of the adoption of the Administrative Procedure Code of Ukraine.

In her speech, the Chief Justice of the Supreme Court Ms. Valentyna Danishevska noted that, when forming law enforcement practice, courts should ensure the balance between rights and guarantees of an individual and the efficiency of functioning of the entire state apparatus.

“The Supreme Court seeks to improve and, in certain cases, radically change the judicial practice, including those aspects, which relate to the public service, in accordance with the Council of Europe standards, given judgments of the European Court of Human Rights”, said Ms. Valentina Danishevska.

“Representatives of the administrative jurisdiction took a strong part in the judicial reform. And the fact that the President of the Venice Commission Mr. Gianni Buquicchio has called the Reform to be “the Copernicus Revolution”, is the achievement, among others, of employees of all administrative jurisdiction – from the Supreme Court to appellate and local courts”, said the Chairman of the HQCJ Mr. Sergii Koziakov, addressing the participants of the conference.

The Chairman of the HQCJ emphasized that the Commission would begin transferring judges, who had successfully passed the qualification evaluation, without a competition to the newly established courts in the coming weeks. “I am convinced that those judges, who have successfully passed an extremely difficult and comprehensive procedure of the qualification evaluation for the compliance with the occupied position, will continue to work in the new courts. By the end of September about two thousand judges, who have passed the qualification evaluation, will have been working in the newly formed courts”, said Mr. Sergii Koziakov.

The agenda of the conference includes the discussion of legal regulation of the public service, declaration of income, relations between the public service and the political service, foreign experience in the legal regulation of the public service, judicial practice in considering administrative cases related to the public service, legal protection of civil servants in administrative courts on the ground of the Constitution and laws of Ukraine.
