Regular meeting with international partners in the framework of establishing the High Anti-Corruption Court took place
On October 26, 2018, the High Qualification Commission of Judges of Ukraine hosted a regular meeting of the Commission’s representatives with international partners, namely: Ms. Eka Tkeshelashvili, Head of the EUACI Programme, Mr. Clemens Mueller, Senior Anti-Corruption Adviser, the EUACI, and Mr. Serhiy Drozach, Senior Legal Advisor of the International Law Development Organization (IDLO).
The parties discussed regulatory framework of future interaction of the Public Council of International Experts (PCIE) and the HQCJ in the course of competition for vacant positions of judges of the High Anti-Corruption Court, in particular, in the form of special joint meetings.
It should be recalled that according to Article 8, part 5 of the Law of Ukraine “On the High Anti-Corruption Court”, at the initiative of at least three members of the Public Council of International Experts, the question of compliance of any candidate for the position of a judge of the High Anti-Corruption Court with the criteria established in Section 4 of this Article, is reviewed at a special joint meeting of the High Qualification Commission of Judges of Ukraine and the Public Council of International Experts. The decision on compliance of such a candidate with these criteria is approved by the majority of the joint staff of the High Qualification Commission of Judges of Ukraine and the Public Council of International Experts provided that at least half the members of the Public Council of International Experts voted for it. If such a decision has not been made, the candidate is considered to cease participation in the competition. This special joint session is held within thirty days from the day of announcement of the results of the exam which the candidates take to establish the candidate’s compliance with the professional competence criteria for the position of a judge.
On the part of the Commission the meeting was attended by Mr. Sergii Koziakov, Chairman of the Commission, Mr. Andrii Vasylenko, Member of the Chamber for selection and public service of judges, Ms. Olena Ponomarenko, Head of the Commission Secretariat and Ms. Yulia Tkachenko, acting Head of International Cooperation Divison of the Commission Secretariat.
