Regulation on holding competition for position of member of the High Qualification Commission of Judges of Ukraine approved
On December 10, 2019, at the session of the High Council of Justice, the Regulation on holding a competition for the position of a member of the High Qualification Commission of Judges of Ukraine approved.
The Regulation defines the procedure and conditions for filling a vacant position of a member of the HQCJU, the submission to the High Council of Justice of the recommendation on appointment of a candidate for position of a member of the HQCJU upon the competition results.
Let us recall that on November 7, 2019, the Law of Ukraine dated October 16, 2019, № 193-IX “On Amendments to the Law of Ukraine “On the Judiciary and the Status of Judges” and some laws of Ukraine concerning the activity of judicial administration bodies” came into force.
Article 95 of the Law of Ukraine “On the Judiciary and the Status of Judges” (in the wording of October 16, 2019) stipulates that the appointment of members of the High Qualification Commission of Judges of Ukraine shall be carried out by the High Council of Justice in accordance with the competition results within the procedure provided for by this law.
Pursuant to Article 951 of that law, the competition provisions shall be approved by the HCJ.
The Regulation stipulates that the competition shall be announced on the basis of decision of the High Council of Justice, adopted at its plenary session.
