Representatives of the Commission’s Secretariat participated in the Ukraine-EU Dialogue on Intellectual Property Rights
On 20 June 2018, in the office of the European Union Delegation to Ukraine with the support of the Ministry of Economic Development and Trade of Ukraine a regular meeting of the Ukraine-EU Dialogue on Intellectual Property Rights, which was attended by the Deputy Head of the Secretariat of the High Qualification Commission of Judges of Ukraine Mr. Oleksandr Bystrushkin and the Chief Specialist of the International Cooperation Division of the Commission’s Secretariat Mr. Denys Kuznetsov, was held.
The event was aimed to discuss the issues devoted to the progress of the reforms in the field of intellectual property, the state of implementation of the Free Trade Agreement between Ukraine and the EU, institutional structure in the field of intellectual property, law enforcement within the activities of the enforcement and customs authorities of Ukraine, settlement of disputes in courts within the judicial reform and legislative changes, as well as the copyright and internet piracy, the draft Law on Inventions and Utility Models, compulsory licensing and trademarks.
During his speech, the Deputy Head of the Commission’s Secretariat informed the participants about temporal perspectives and the current state of the organization of the competition to the High Court on Intellectual Property.
Thus, on 29 September 2017, under the Presidential Decree of Ukraine, the High Court on Intellectual Property was set up. The State Judicial Administration of Ukraine determined the number of seats in this body, namely 21 judges.
On 30 September 2017, the High Qualification Commission of Judges of Ukraine announced the competition to the High Court on Intellectual Property.
The stages of the competition to a higher institution for consideration of issues related to intellectual property are: establishing compliance of persons with the law requirements; conducting a special check; the qualification evaluation, which includes testing of the knowledge of law, the practical assignment and testing of personal moral and psychological qualities and general abilities, including an interview with a psychologist, dossier examination and interview with the Commission, the rating formation and defining winners.
234 persons have applied for the Commission to participate in the competition. As a result of establishing compliance of individuals with the requirements for a candidate for the position of a judge of the High Court on Intellectual Property, 219 persons were admitted to the competition. For today, these candidates are undergoing a special check.
“The Commission within its powers under the Law of Ukraine “On the Judiciary and the Status of Judges” is doing its best that in the III quarter of 2018 those candidates, who have successfully completed the special check, pass the exam, and in the IV quarter of 2018 they were interviewed by the Commission”, said Mr. Oleksandr Bystrushkin.
The event was also attended by representatives of the European Commission, the Project of the Queen Mary University in London, ministries and institutions, Ukrainian and European businesses.
As a result of the meeting, the participants agreed on joint cooperation.
