Representatives of the High Qualification Commission of Judges of Ukraine took part in the conference on the excessive length of civil and criminal proceedings in Ukraine
On 27 October 2016 the Secretary of the Disciplinary Chamber of the Commission Mr. Mykhailo Makarchuk took part in the conference on “Excessive length of civil and criminal proceedings in Ukraine in the context of the case-law of the European Court of Human Rights: possible solutions and effective remedies.” The event was jointly organized by the High Specialized Court of Ukraine for Civil and Criminal Cases, the Government Agent before the European Court of Human Rights and the Council of Europe Project “Support to the implementation of the judicial reform in Ukraine”.
The conference was aimed to discuss the problem of excessive length of judicial proceedings in determining the rights and obligations of civil or criminal charges against the person in Ukraine in accordance with the judgements which are under control of the Committee of Ministers and to inform the authorities on the best European practices and recommendations of Europe on possible means of effective remedies against excessive length of court proceedings.
Upon the discussion participants considered the reasons and further measures to be taken to address this problem; ways of respond in cases of excessive length of proceedings; creation of national mechanisms of compensatory and preventive means of effective remedy against this problem.
As a result the participants developed general recommendations to address these issues and the issue of creation of remedies at the national level to respond the excessive length of proceedings; expressed their suggestions for further areas of cooperation with the Council of Europe.
The attendees of the conference included the judges and representatives of the Supreme Court of Ukraine, the High Specialized Court of Ukraine for Civil and Criminal Cases, judicial authorities of Ukraine, the High Council of Justice, the Ministry of Justice of Ukraine, the Prosecutor General of Ukraine, the National Police of Ukraine, advocacy, international NGOs representatives and experts of the Council of Europe, chairmen of the appellate courts of general jurisdiction and Government Agent before the European Court of Human rights.
