Round table on judgment of the European Court of Human Rights in the case “Oleksandr Volkov v. Ukraine”
On 28 October, 2015 in the framework of the Council of Europe Project “Strengthening the system of judicial accountability in Ukraine” there was held a round table on judgment of the European Court of Human Rights in the case “Oleksanr Volkov v. Ukraine.”
The round table was attended by Mr. Mikhailo Makarchuk, Secretary of the Disciplinary Chamber of the High Qualification Commission of Judges of Ukraine, Mr. Oleksandr Nechytailo, Chairman of the High Administrative Court of Ukraine, Mrs. Valentin Simonenko, Chairman of the Council of Judges of Ukraine, Mr. Borys Babin, the Government Commissioner of Ukraine in the European Court of Human Rights, Mr. Oleh Kryvenda, judge of the Supreme Court of Ukraine, Mr. Oleksandr Volkov, judge of the Supreme Court of Ukraine, Mr. Viktor Horodovenko, Chairman of the Appellate Court of Zaporizka oblast.
At the event the Council of Europe was represented by Mrs. Hannah Juncker, Head of the Department of Justice and Legal Cooperation, Mr. Ðuro Sessa, Judge of the Supreme Court of Republic of Croatia, Vice-President of the Consultative Council of European Judges, Mr. Gerhard Reissner, President of the Austrian Association of Judges, President of the District Court of Floridsdorf (Vienna), Member of the Venice Commission.
During the first session of the round table Mr. Ðuro Sessa, Vice-President of the Consultative Council of European Judges and Mr. Viktor Horodovenko, representative of Ukraine in the Consultative Council of European Judges, Chairman of the Appellate Court of Zaporizka oblast presented to participants Opinion No.18 of the Consultative Council of European Judges on “The position of the judiciary and its relations with other powers of the state in a modern democracy”, which was adopted in Strasbourg on 16 October of this year. The Opinion chiefly applies to the principle of division of powers, elements of legitimacy and different forms of interaction between the judiciary and other branches of government.
The second session was devoted to the judgment of the European Court of Human Rights in the case “Oleksand Volkov v. Ukraine” and its impact on justice administration in Ukraine and other countries.

The Council of Europe Project “Strengthening the system of judicial accountability in Ukraine” was launched in January, 2015 and will have been operating until December, 2015.
The objectives of the Council of Europe Project are the following:
1. Development and adoption of legislative amendments which are necessary as general measures within the enforcement by Ukraine of the European Court of Human Rights judgments in cases “Oleksandr Volkov v. Ukraine” and “Salov v. Ukraine”
2. Improvement of rules and procedures of disciplinary bodies to ensure fair and effective disciplinary cases relating to complaints against judges.
