The Council of Europe insists on consultation on Draft Law №1008

On September 25, 2019, the Committee of Ministers of the Council of Europe decided to implement Ukraine’s decision of the European Court of Human Rights in the case of Oleksandr Volkov vs. Ukraine. Among other things, the Ministers’ Deputies “noted the adoption in the first reading of Draft Law № 1008 aimed, in particular, at amending the disciplinary system and career of judge; emphasized that the proposed changes to the legislation should be in conformity with the Convention and the case-law of the Court, the principles of the independence of the judiciary set out in the judgment Oleksandr Volkov vs. Ukraine and the relevant recommendations of the Council of Europe; called on the authorities to make full use of the Council of Europe’s expertise in this matter”.

We remind you that the adoption by the Verkhovna Rada of Ukraine in the first reading of Draft Law № 1008 has caused numerous criticisms from the High Council of Justice, the Council of Judges of Ukraine, the Plenum of the Supreme Court, the National Bar Association of Ukraine, the Association of Lawyers of Ukraine, the Delegation of the European Union to Ukraine and the Embassy of Canada .
