The first thousand of judges completed the qualification exams – five of them have not passed

On March 15, the first group with a total number of 988 judges of local and appellate courts completed passing the exam under the qualification assessment for the compliance to the position of a judge. The Commission has already determined the results of the exam for 332 judges – five of them have not passed it, others are waiting for interviews.

The qualification assessment within the frameworks of judicial reform is compulsory for all 5700 judges of local and appellate courts of the country. It helps to determine the judge’s ability to administer justice in a relevant court.

“For the first time, all judges are assessed according to the complex criteria: professional, personal and social competence, integrity and professional ethics. Thus, there is a staff re-loading of the judicial branch of power, since refusing to have been assessed or failing to pass it is the reason for a judge to be dismissed”, said Mr. Sergii Koziakov, the Chair of the HQCJ, and added that the same criteria were used to select the judges for the new Supreme Court.

The assessment takes place by completing a two-level exam for a judge, consisting of anonymous testing on the level of law knowledge and the practical task on the ability to write logical and motivated court decisions, as well as studying of a judicial dossier and interviewing with the members of the Commission.

Exams for the first group of judges lasted from February 14 till March 15, and for that period of time were passed by 942 out of 988 judges,
402 judges from local courts, and 540 judges from appellate courts.

Among judges of local courts, the exam was passed by:

    - 291 judges of general courts;

    - 55 judges of commercial courts;

    - 56 judges of district administrative courts.

Among judges of appellate courts, the exam was passed by:

    - 392 judges of general courts;

    - 35 judges of commercial courts;

    - 113 judges of administrative courts.

46 judges who did not appear for the exam based on valid reasons will pass exams later.

The Commission has already determined the results of the examination for 332 judges. 5 out of them did not pass the exam (one judge of the commercial court of appeal and four appellate court judges). All others were admitted to the next stages of the assessment – interviews and studying of judicial dossiers, which will begin on March 23. For a successful passing of the assessment, a judge must score 2/3 of 1000 points.

The next group of 1790 judges began to pass exam on February 22, 2018. Previously, 500 judges have already passed the qualification assessment, so now it should be passed by another portion of 5200 judges from all over Ukraine. The Commission plans to complete the qualification assessment of all judges by the end of current year.

All citizens who have factual information on the integrity and ethics of judges in their residential areas can contribute to the assessment procedure and submit such information to the High Qualification Commission of Judges of Ukraine and the Public Integrity Council.
