The submission on dismissal of 2 judges due to oath violation was filed
Pursuant to the decision of the High Qualification Commission of Judges of Ukraine, dated 17 December 2015 № 3884/dp-15, at the meeting of the High Council of Justice, held on 4 August 2016, it was decided to file a submission to the President of Ukraine on the dismissal of 2 judges due to oath violation – Mr. Pavel Medentsev, judge of Commercial Court of Odeska oblast, and Mr. Mykola Boiko, judge of Donetskyi County Administrative Court of Ukraine.
The Commission recommendation indicates that Mr. Pavel Medentsev, judge of Commercial Court of Odeska oblast, from 8 April 2014 until today, with the exception of holiday’s period, was out of his office without justifiable reasons, doesn’t administer justice, doesn’t inform about his place of stay and reasons of his absence from work. i.e. he violated oath.
The disciplinary case against Mr. Pavel Medentsev was opened by the Commission on 13 May 2014 upon the appeal of Mr. V.Petrov, the head of the Commercial Court of Odeska oblast.
The Commission also submitted a recommendation to the High Council of Justice, dated 17 May 2016, on the submission of Mr. Mykola Boiko, judge of Donetskyi County Administrative Court of Ukraine, due to oath violation.
The decision of the Commission, dated 17 May 2016, № 994/dp-16 indicates that the grounds for the opening of the disciplinary case against Mr. Mykola Boiko was the appeal of Mr. Viacheslav Kirienko, the head of the Donetskyi County Administrative Court of Ukraine, according to which Mr. Mykola Boiko from 21 November 2014 has not started his official duties, envisaged in the Decree of the President of Ukraine of 12 November 2014 № 866/214 and relevant internal act of the Donetskyi County Administrative Court of Ukraine, at the new location of the court (Sloviansk city).
Besides, on the web-site of so-called Donetsk People's Republic a decree of its Head, Mr. O.Zakharchenko,dated 17 March 2016, № 71, is posted, according to which Mr. Mykola Boiko is appointed for the position of judge of another court of Donetsk People's Republic.
The Commission was also to consider one more recommendation of the Commission, dated 17 May 2016, on the submission of the dismissal of Mrs. Taisiia Matiash, judge of Bilgorod-Dnistrovskyi Interdistrict Court of Odessa oblast due to oath violation. However the consideration of the issue by the High Council of Justice was deferred due to judge’s illness.
