Two courts of Ukraine remain without judges
In Ukraine, the situation in local courts will be improved in the nearest future. After all, according to the results of the competition conducted by the High Qualification Commission of Judges of Ukraine, the excessive workload will be overcome or administering of justice will be restored in 115 courts.
Recommendations on the nomination of 467 candidates to positions of judges in 263 general local courts have already been sent by the HQCJU to the HCJ. Therefore, once the HCJ adopts the decision on submitting to the President of Ukraine the appointment of judges and the President issues appropriate decrees, the situation with accessing to justice in the courts of the first instance will be improved significantly.
“Reloading of the Judge Corps cannot be quick. It takes a year and a half or two years to prepare a new judge – from the moment the competition is announced until the Presidential decree. In 2016, due to the changes in the law, the Commission did not have a reserve for replacing vacant judicial positions. Therefore, when the judges began to quit en masse, in particular, because of their unwillingness to undergo a qualification evaluation process, there was a significant staff shortage in the courts,”- noted the Secretary of the Chamber for Selection and Public Service of the High Qualification Commission of Judges of Ukraine, Mykhailo Makarchiuk.
Further, justice will not be administering in two courts of Ukraine. It is the Avdiivskyi City Court of Donetsk Region, where there are judges without authority and the Stanychno-Luhanskyi District Court of Luhansk Region. Unfortunately, the situation in these courts will remain unresolved for some period of time.
Filling judicial vacancies is one of the priority procedures of the High Qualification Commission of Judges of Ukraine today.
It should be reminded that on August 5, 2019, the HQCJU announced a competition for the appointment of 7 vacant positions of judges in the local general courts of Donetsk and Luhansk Regions for candidates for the position of judge, as well as 35 positions in local courts of Ukraine. In addition, on August 9, 2019, the Commission announced a competition for the recruitment of 346 judicial positions in appellate courts, 54 vacant judicial positions of judges in local administrative courts and 22 vacant judicial positions in local commercial courts.
