Ukrainian Bar Association and the High Qualification Commission of Judges of Ukraine discussed the amendments to the Commission Regulations on disciplinary cases review
The round table with participation of Ukrainian Bar Association and the High Qualification Commission of Judges of Ukraine was held on 6 October, 2015. The topic of the event was “HQCJU Regulations as the basis for efficiency of disciplinary cases review.”
Mr Denys Buhai, UBA President noted that the Association began the project of monitoring the effectiveness of bodies that in charge of brining judges to disciplinary liability and the HQCJU is the first on this list.
The participants discussed the issues of following the reasonable timeframes and conditions of factitious delaying consideration of disciplinary cases.
During the round table it was proposed to consider the cases of the same type by packages. However, Mr Pavlo Lutsiuk, Member of the HQCJU marked that such approach undermines the principle of individual responsibility, since the quality of case review depends on the quality of prepared case materials.
In addition, it was also discussed that the complainants often don not have the right to appeal the decision of the Commission on refusing to initiate disciplinary proceedings and on its termination. Mr Lutsiuk stressed that such issue is not within the competence of the HQCJU but refers to the legislator competence.
