Concerning qualification exam of candidates for position of a local court judge
Qualification exam appointed by the Commission on June 07, 2019 within the procedure of selecting candidates for a position of a local court judge will be held from July 25 to August 29, 2019 at the Commission's premises at the following address: 9, General Shapoval Str., Kyiv.

Passing of qualification exam by candidates for a position of judge includes the following stages:
1) written anonymous testing (hereinafter testing), duration - 120 minutes (maximum score - 90) is a mandatory stage for all participants of the exam;
2) anonymous written practical assignment (hereinafter practical assignment) on selected specialization(s),duration - 300 minutes (maximum score - 120).
It is planned that the issue of candidates’ admission for the practical assignment will be considered by the Commission on August 1, 2019. A candidate is considered to have failed the exam, in particular, if he/she receives less than 75 percent of the maximum possible test score (less than 67.5 points).

Note: In case of non-compliance of the name of the person indicated on the list, in particular, in connection with person’s change of name, it is necessary to notify the Commission immediately (by calling (044) 233-63-85) and bring on the exam the document confirming the relevant changes.
A practical assignment will be performed by the use of computer equipment.
The exam will be supported by authorized representatives.
For candidates, during the exam, the announcements of authorized representatives regarding the procedure of the exam and the movement in the exam room will be made. Please carefully listen to the ads and follow the instructions.
Schedule of the testing day:
09:00 – opening of the door for entrance to the exam room;
09:00 – 09:30 – registration of candidates for testing;
10:00 – 12:00 – testing;
13:00 – 13:30 – verification and setting of coded test results.
Schedule for the practical assignment day:
09:00 – opening of the door for entrance to the exam room;
09:00 – 09:30 – registration of candidates for practical assignment;
10:00 – 15:00 – practical assignment.

We ask candidates to appear for registration beforehand!
Before entering the exam room, the candidate should turn off the mobile phone and other electronic devices for recording, playing, receiving and transmitting information.
To enter the premises and register for the test the candidate should present a document certifying the identity and citizenship of Ukraine (passport of a citizen of Ukraine).
Without a document certifying the identity and citizenship of Ukraine, candidates shall not be allowed to the test room!
During the registration for testing the following actions will be carried out:
1) the generation by a special software complex of the individual code (hereinafter referred to as the code) solely for the purpose of passing the test;
2) issuing of the individual card of the participant of the exam for testing and implementation of a practical task on the specialization of the local general court;
3) handing out general testing rules (a sample of rules is by the link).
During registration for a practical task on the specialization of the local court the following actions will be carried out:
1) generation of a special program code exclusively for the implementation of a practical task with the relevant specialization;
2) issuing individual card of the participant of the exam for the implementation of practical tasks in the specialization of the local administrative and economic court (for the implementation of a practical task on the specialization of a local general court, a card issued to a participant during registration for testing is used);
3) handing out general rules for the implementation of a practical task (a sample of rules is by the link);
4) handing out a memo with the settings for the Microsoft Word document (a sample of the memo is available by the link).
For each individual stage of the test, a separate code will be generated for the candidate.
Codes generated for the candidate during registration are indicated on the individual card of the exam participant. On the reverse side of the individual card there is a sample of the correct filling of the mandatory code fields by the candidate in the response form and the title page of the notebook for the practical assignment.
Issued at the time of registration, an individual card is the only document by which the candidate can find out his own coded results of the individual stages of the exam.
Keep an individual card before the Commission determines the overall results of the qualification exam (which were decoded)!
A candidate card will be issued to the candidate on the test day.
Applicants admitted to the practical assignment of specialization of a local general court for taking the assignment should carry an individual card issued at the time of registration for testing.
A new individual card will be issued for the practical assignment of specialization of the local administrative court.
Applicants admitted to the implementation of practical assignment in the specialization of the local administrative court and local economic court, in order to accomplish a practical assignment on the specialization of the local economic court, should carry an individual card issued during registration for taking a practical assignment on the specialization of the local administrative court.
For candidates admitted to the practical assignment of specialization of the local economic court and not admitted to the practical assignment with specialization of the local administrative court, a new individual card will be issued for the purpose of carrying out a practical assignment on the specialization of the local economic court.
The wardrobe (without a coat-check person) will work in the premises for passing the exam.
Taking the exam in outer clothing and hats is prohibited!
Applicants who have not passed the registration procedure and have not delivered the outerwear to the wardrobe shall be allowed to the exam.
The entrance to the exam room will be carried out in the presence of an individual card and identity document (passport of a citizen of Ukraine).
At the entrance to the exam room, as well as at the request of the authorized representative, the candidate must present an individual card and a document certifying the identity. Moving candidates in the room without these documents is prohibited.
Immediately after admission to the test room, the candidate must independently choose a place and stay at this place. From this time and until the completion of the examination materials of the relevant stage of the examination, the candidate is not allowed to move in the room without the permission of the authorized representative and go outdoors, in particular for smoking.
Each candidate's workplace will be provided with a pen, a bottle of water (0.5 liters), and a package for the placement of personal belongings that are prohibited to use during the exam.
Applicants should use the pen provided by the Commission during the exam.
The package with personal things during the exam must be at the candidate's place of work.
At 09:30, candidates must be at their places to receive exam materials.
From that time, it is not allowed to have forbidden materials on the tables at the appropriate stage of the exam.
From 09:30 to 10:00, candidates are not allowed to leave the workplace, in particular to dressing room.
During the completion of the individual examination stages, the movement of candidates in the room, in particular for visiting the dressing room, may be carried out solely with the permission and accompanied by an authorized representative.
If necessary, apply to the authorized representative during the exam, in particular to inform about the intention to go to the dressing room, remaining at the workplace, raising the hand and, without interfering with other candidates, wait for authorized representative.
Candidates are allowed to go out one by one. The next candidate can go to the dressing room after returning of the first one.
To go to the dressing room during the exam (testing, practical assignment), the candidate must: 1) leave the examination materials at his / her place of work; 2) bring individual card along with.
If the candidate is late for the exam, he/she have the right to undergo the registration and complete separate stage within the time allowed for this. There is no additional time in this case.
The candidate may refuse to take the exam; the relevant act should be drawn up. Such a candidate should pass the exam materials to the authorized representative and leave the exam room.
Immediately after the announcement of the completion of the appropriate exam time period, the candidate is required to turn back the response form and/or close the notebook received for this stage, put the pen and, while remaining at his place of work, wait for the authorized representatives to collect these materials. The fact of submitting the exam materials must be certified in the submission of the examination materials by examiners. A candidate who has not passed the exam materials and has not certified the fact of their surrender must remain at the workplace before the respective actions are taken.
In the case of extraordinary situation, the candidate must notify the authorized representative thereof and act in accordance with the instructions given.
The examination is fixed by technical means of video and audio recording.
Examination rules
During the exam, the candidate has the right to:
1) polite and impartial attitude towards themselves;
2) water on the table, medicine and ruler;
3) use of a test notebook and notebook with practical assignment for any convenient records;
4) use during the implementation of practical task exclusively such normative legal acts: laws, codes, in particular commented, resolutions of plenums, as well as decisions of the European Court of Human Rights. The indicated regulatory acts are used with the help of the electronic devices provided by the Commission, as well as paper carriers of candidates, but only the publishing replicas;
5) early delivery of examination materials, but not later than 5 minutes prior to the completion of the relevant exam stage;
6) the presence during the generation by a special software set of test questions and model litigation and their replication;
7) identification of the fact of the closure of safe-packets with response forms and notebooks for practical assignment;
8) presence during the verification of response forms at the place of demonstration of their results;
9) refusal to compile the appropriate test phase within the time allowed for this.
During the exam, a candidate is prohibited from:
1) violating discipline and generally accepted rules of conduct;
2) communicating with other candidates, in particular, to receive from them or to transfer information to them, to take the exam instead of them;
3) leaving the workplace and the examination room without an individual card and permission of authorized representatives;
4) taking the exam before and after the announcement of the beginning and end of the relevant stage;
5) bringing outerwear and hats on the exam, carry bags, briefcases, etc. (in the presence of such things they must be put into the package for this purpose);
6) using during the test any sources of information on paper and/or electronic devices;
7) using and having at the table, during the performance of a practical assignment, any things or sources of information other than a notebook for performing a practical assignment, a notebook with practical assignments, an individual card, water, medicine, a document certifying a person, as well as permissible regulatory legal acts;
8) using photo, audio, video and other means for recording, reproducing and receiving-transmitting information, including mobile phones, electronic books, smart watches, headphones, etc.;
9) coping or breaking the integrity of the exam materials;
10) inserting (using) in the response form and notebook for the practical assignment any marks, symbols, letters, words not provided by them and/or allowing to identify of the person;
11) making corrections in the response form and on the title page of the notebook for the practical assignment;
12) changing the response form after the announcement of the beginning of the test;
13) taking out the examination materials from the exam room, both during and after the completion of the relevant stage;
14) carrying dangerous items and substances that may endanger the life and health of other persons who are at the test room, as well as objects that may interfere the examination.
During the exam, the candidate must:
1) treat the authorized representatives, observers and other candidates politely;
2) follow the instructions and requirements of the authorized representatives;
3) at the time of taking the exam, put personal belongings (if any), in particular mobile phones and smartwatches turned off, to the package designated for this;
4) have on the table a document certifying his/her identity and citizenship of Ukraine, an individual card, pen, and examination materials;
5) fill in the answer sheet correctly and on the title page of the notebook to complete the practical assignment generated for the corresponding test phase of the code;
6) correctly fill in the answer sheet the number of the variant of the received test notebook;
7) upon completion of the time allowed for the corresponding stage of the exam, hand over all the examination materials received in the order of priority determined by the authorized representatives;
8) adhere to the rules of taking the exam.
Peculiarities of testing
To complete the test, the candidate will be provided with:
1) answer sheet;
2) test notebook.
The answer form and the test note book are paper documents.
Test notebooks are not checked or evaluated and not individual!
In the test book, the candidate can make any convenient tags, entries, markings, etc. At the end of the test notebook there are scratch papers – clean sheets of paper.
Using your own clean sheets of paper, notebooks, etc. is not allowed.
It is forbidden to violate the integrity of the test notebook.
At the center of the title page of the test booklet contains an inscription with the variant number, which must be displayed in the response form.
The number of questions in the test book is 80.
Each question has four answers, among which only one is correct.
The basics and samples of test questions have been pre-announced on the official website of the Commission in the «Tasks (questions)» of subsection «Qualification Exam» of section «Selection of candidates for a position of judge».
The response forms are checked, evaluated and are individual!
Required fields to fill in the answer sheets are:
1) the graphic field of the code;
2) the code field by cursive;
3) the field of the variant of the test notebook.
The candidate's test code will be on the left side of his/her individual card.

To go beyond the squared answers provided in the form, and also to put in it any characters, letters, words, marks not provided by it, is prohibited.
Correcting an answer sheets is also prohibited!
Before the announcement about the beginning of the test: 1) the candidate shall fill in the mandatory fields of the answer sheets; 2) replacement of the spoiled response form is allowed.
The correctness of filling an answer sheets is the responsibility of the candidate!
Failure to complete and/or incorrectly fill mandatory fields of the response form may prevent its detection and recognition; as a result such work will be rated at 0 points.
Also in the response form there are fields for filling the correct, in the opinion of the candidate, answers to the questions of the test notebook. The number of such fields in the response form is 80.
Method of calculation of the test score:
1) the correct answer to one test question - 1,125 points;
2) incorrect answer to one test question - 0 points;
3) failure to answer one test question - 0 points;
4) giving two or more answers to one test question - 0 points;
5) all points are summed up;
6) non-designation or incorrect indication by the candidate of the variant number of the test notebook – 0 points for test.
A candidate, who did not appear on the test or refuse to complete the test, is not allowed to complete a practical task (from any specialization).
Peculiarities of the practical assignment
To fulfill the practical assignment, the candidate will be provided with:
1) the title page of the notebook for the practical assignment;
2) a laptop;
3) a notebook with a practical assignment.
On the title page of the notebook for the implementation of the practical assignment, the only and mandatory for filling by candidates are:
1) the graphic field of the code;
2) the code field by the cursive.

To go beyond the borders provided on the title page for the practical task of the squares, as well as to put on it any characters, letters, words, marks not provided by it, is prohibited. Corrections on this page are also forbidden.
Before the announcement of the beginning of the implementation of the anonymous written practical assignment the candidate: 1) shall to fill in the obligatory fields of the title page of the notebook for the practical assignment; 2) is allowed change the damaged title page of the notebook.
Failure to complete and/or incorrectly filling the required fields of a notebook for a practical assignment may prevent its detection and recognition, which results in such work being rated at 0 points.
Notebooks with practical tasks are not checked, evaluated and not individual!
A practical notebook is a paper document in which the candidate can make any convenient tags, entries, notes, etc. At the end of a notebook with a practical assignment there are scratch sheets - clean sheets of paper.
Using your own clean sheets of paper, notebooks, notebooks, etc. is not allowed.
Violating the integrity of a notebook with practical assignments is prohibited.
The number of practical assignments that candidates will carry out within a specialization is 1.
The volume of the notebook with the practical assignment is up to 80 pages.
A notebook with a practical task will contain a set of materials for a model case. The final document of a notebook with a practical assignment is already formed part of the model court decision.
Examples of practical assignments in all specializations have been published on the official website of the Commission in the «Task (Question)» of subsection «Qualification Exam» of section «Selection of candidates for a position of judge».
The practical assignment is carried out by continuing to explain the text of the model court decision to the candidate by the results of consideration of the merits of the materials of the model case, which is contained in a notebook with a practical task.
A practical task is carried out on laptops using a Microsoft Word document.
The candidate shall not to retype part of the text of a model court decision contained in a notebook with a practical assignment.
For the candidate during the implementation of the practical task, it is required to extend exclusively the extension of the text of the model decision in the Microsoft Word format document.
The practical assignment shall be performed in accordance with the legislation that is in force at the time of its execution.
In the notebook for the practical assignment, candidates are prohibited from making any marks (symbols, letters, words, etc.), through which the person of the participant of the exam can be identified, in particular, to indicate their own surname! The work of the candidate who made the corresponding marks is estimated at 0 points.
The correctness of filling out the title page of a notebook for the practical assignment execution and the design of a model court decision is the responsibility of the candidate!
During the implementation of the practical assignment, it is permitted to use only such normative legal acts and only on paper carriers of publishing duplication: laws, codes, in particular commented, resolutions of plenums, as well as decisions of the European Court of Human Rights.
Violation of the integrity of the reproduction of normative legal acts before and/or during the implementation of the practical task is not allowed.
The following sources of information are prohibited:
- texts of court decisions based on the results of consideration of the merits by the courts of Ukraine;
- newsletters;
- analysts of the cases before the courts of Ukraine;
- collections of itemized pointers of legal positions;
- scientific and methodical literature.
For the practical assignment, each candidate's laptop will be accessible exclusively to the following official websites:
1) European Court of Human Rights (https://hudoc.echr.coe.int);
2) Verkhovna Rada of Ukraine (https://rada.gov.ua);
3) LIGA: ZAKON (https://ligazakon.net) - the use of the VERDICTUM judgment analysis system is strictly prohibited.
Access and use of other resources is not allowed!
After announcing the completion of a practical assignment time, the candidate is obliged to immediately stop working on it, remove the hands from the keyboard of the laptop and the mouse manipulator, stay in the workplace and wait until the authorized representatives gather the exam materials.
The notebook for the practical task is a paper document, which is formed after the completion of the corresponding stage of the exam by replicating the authorized representative of the text printed by the candidate and attaching it to the pre-filled cover sheet for the practical assignment.
Notebooks for practical tasks are checked, evaluated and are individual!
The results of the practical task performed by the candidate are set by the members of the Commission on a scale from 0 to 120 points, after which the estimation of the work is carried out by means of the estimation of the average arithmetic score of the Commission – the final evaluation for the practical assignment for each candidate is deduced (by rounding to the approximate integer or number with the coefficient 0.5).
The strict observance of the rules of the exam is the responsibility of the candidate. Ignorance of these rules does not relieve the responsibility associated with participation in the qualification exam. The fact of the candidate's violation of the rules for passing the exam will be recorded in the act, which may be the reason for the decision of the Commission to recognize the candidate as the one who had not passed the exam!
