The High Qualification Commission of Judges of Ukraine informed that the situation regarding administration of justice in local courts would be improved in the nearest future. Presentation of Report on results of the study «Attitude of Ukrainian Citizens to Judicial System»
In order to study the attitude of Ukrainian citizens to the judiciary and their assessment of various aspects of the court’s work, the sociological service of the Razumkov Center, commissioned by the Council of Europe's Office in Ukraine, conducted two sociological surveys: a representative survey of Ukrainian citizens and a survey of participants in court sessions at the exit from court premises.

Regular meeting on Intellectual Property Dialogue between Ukraine and EU took place

On March 06, 2019, the High Qualification Commission of Judges of Ukraine summarized the results of the qualification evaluation and approved the ratings of candidates for vacant positions of judges of the High Anti-Corruption Court and the Appeal Chamber of the High Anti-Corruption Court. The competition for these positions in the new court being established within the framework of judicial reform in Ukraine lasted from August 2, 2018 and became one of the most transparent in the world regarding publicity of the procedures.

The High Qualification Commission of Judges of Ukraine transferred 156 case studies taken by candidates for the positions of the High Anti-Corruption Court on November 14, 2018 to the Public Council of International Experts. Psychological testing appointed for 2479 judges
For the purposes of forming judges’ dossiers, on December 12, 2018 the High Qualification Commission of Judges of Ukraine adopted decision to appoint testing for the purpose of checking personal moral and psychological qualities and general abilities of 2479 judges within the framework of the qualification evaluation procedure for eligibility for the position held and in connection with the imposition of a disciplinary sanction.

On December 5-6, 2018, in Vienna, Austria, within the framework of the EU Eastern Partnership Initiative, the e-Justice conference was held to address current IT solutions with regards to the electronic files in the European Union. On 5 and 6 July 2018, the First International Scientific and Practical Conference “Public Service and Administrative Proceedings: Achievements and Challenges” is being held at the Supreme Court premises. Examination program for the qualification evaluation of judges and candidates for the position of judge of the High Court on Intellectual Property
In order to provide an examination within the framework of the qualification evaluation of judges and candidates for the post of judge of the High IP Court on May 17, 2018, the HQC approved the corresponding exam program and taxonomic characteristic to it.

91 judges have not confirmed their compliance with the occupied position
The HQCJ continues to conduct the qualification evaluation of the judicial corps of Ukraine. 2969 judges in two groups of 999 and 1970 judges are undergoing the evaluation. As of 7th June 2018, the evaluation of 868 judges, subjected to the evaluation, has been completed.

Already 10% of judges did not confirm compliance with the position held
As part of the judicial reform, qualification assessment of judges is continued in Ukraine. As of May 14, 2018, 10% of the judges who passed the qualification assessment did not confirm their compliance with the position held.

Every fourth judge has not passed the qualification assessment – first results
According to the results of 12 days of interviewing the first thousand of judges, 431 judges (75% of judges) comply with the occupied position, 16 Themis representatives were recognized as those who have not confirmed the ability to administer justice. Regarding 103 judges, a break was announced, in particular due to the improperly drawn Public Integrity Council opinions

74% of judges under the results of the first six days of interviews have confirmed compliance with the occupied position
During the past two weeks, 286 judges from the first thousand were interviewed within the frameworks of qualification assessment. 212 of them have confirmed the compliance with the occupied position, in relation to the 64 judges there were declared a break – mainly due to the opinions of the PIC, 4 judges did not confirm the ability to administer justice.

Results of PIC participation in the procedure of the qualification assessment of judges for their position compliance
We would like to inform you, that for the purposes of the qualification assessment of judges for their position compliance as of 27.03.2018, the Commission has received from the Public Council of Integrity opinions and information regarding 106 judges.
The HQCJU will continue the qualification assessment of judges and urges the PIC to conduct its duties in accordance with the law
The Public Integrity Council carries out an important role in the process of assessing the country’s judiciary. The Commission proposes the PIC to continue performing its duties and take into account the simple rules for documents drafting – this approach will facilitate real help in resetting the judiciary corps.
Reasons for postponement of cases consideration during interviews with the judge
On March 23, 2018, the Panels of the HQCJU have taken the decision on postponement of cases consideration concerning judges, who participate in the qualification assessment procedure for compliance with the position of a judge.
Commission has started interviewing judges in the framework of the qualification assessment
On 23 March 2018, the High Qualification Commission of Judges of Ukraine started interviewing judges who are passing the qualification assessment for their position compliance. The interviews are based on the results of the judges’ dossiers examination.
Commission has admitted 219 candidates to the competition to the High Court on Intellectual Property
Upon the consideration of documents submitted by 234 candidates for the competition to the High Court on Intellectual Property (IP-court), the HQCJ has admitted 219 candidates. 94 of them are women and 125 are men.

On 19 March 2018, the Interregional Judicial Forum “High Qualification Commission: Everything Depends on Human Resources!” was held in Pidhirtsi village, Kyiv region. The event was organized by the Association for the Development of Judicial Self-Government of Ukraine, the Ukrainian Bar Association and the Commission. The Forum took place within the framework of the Grant Project “Support to the Judicial Self-Government Development” realization, with support of the United States Agency for International Development (USAID) “New Justice” Program.
The first thousand of judges completed the qualification exams – five of them have not passed
On March 15, the first group with a total number of 988 judges of local and appellate courts completed passing the exam under the qualification assessment for the compliance to the position of a judge. The Commission has already determined the results of the exam for 332 judges – five of them have not passed it, others are waiting for interviews.

990 judges from all the regions of Ukraine have started passing the position compliance examination
From 14 February to 15 March 2018, 990 judges from all the regions of Ukraine will pass the two-level examination in the framework of judges’ qualification assessment. This group includes 442 first instance judges and 548 second instance judges. The first 57 out of 990 judges will pass the exam on 14 February.

The XIV Extraordinary Congress of Judges of Ukraine is continued
On 14th November 2017, the XIV Extraordinary Congress of Judges of Ukraine continued its session. One of the key issue of the meeting was the filling of vacant positions in the Constitutional Court of Ukraine. The delegates discussed 6 nominees of 19 who were successfully interviewed by the Council of Judges of Ukraine. Mr. Viktor Gorodovenko, the Chairman of Zaporizhzhya region Court of Appeals obtained the majority of votes, namely 186, and became a judge of the Constitutional Court of Ukraine.

In order to assess the integrity of candidates for the positions of judges, the Public Integrity Council should develop objective and formalized criteria. Such position was emphasized in the draft Report on the results of monitoring of Public Integrity Council functioning in line with the standards and recommendations of the Council of Europe, which was presented to the expert community on 28th of September 2017.

On the dissemination of inaccurate information by the Public Council of Integrity
The Public Integrity Council exceeds its powers within the Supreme Court Competition and requires this from the President of Ukraine. As a result of the judicial reform, all political institutions have lost the opportunity to influence the appointment or dismissal of judges. Nowadays, the dismissal/appointment of judges belongs exclusively to the powers of the High Council of Justice.

On 30 March 2017, the presentation of the draft Report on the results of the analysis of the anti-corruption normative regulation in the judiciary on its compliance with the principles of independence and accountability of judges took place at the National Academy of Sciences of Ukraine. The author of the report is Mr. Mykola Khavroniuk, Doctor of Law, professor, expert of the Center for Policy and Legal Reform, expert of the USAID New Justice Program.

On 24 March 2014 a round table devoted to the Ukrainian reforms “Transforming the country: Ukraine on the path of reforms” took place in Vienna. During the meeting, Mr. Sergii Koziakov, the Chairman of the High Qualification Commission of Judges of Ukraine (HQCJ), called the competition to the Supreme Court the main event of the year in Ukraine and noted that it should be completed in May. Working visit to the Republic of Estonia took place
On 14-18 February 2017, a representative of the High Qualification Commission of Judges of Ukraine took part in the working visit to Tallinn (the Republic of Estonia) within the delegation of Ukraine. The visit was devoted to familiarization with the communication system of the Estonian Government in the judicial area and was financed by the Ministry of Foreign Affairs of the Republic of Estonia.

In early February 2017 in Kyiv under the support of the OSCE, UNESCO, the Ministry of Foreign Affairs of Ukraine and the Ministry of Information Policy of Ukraine, Institute of Mass Information there was held a conference on the safety of journalists as a condition for free media. For judges from the Autonomous Republic of Crimea
Due to the impossibility of sending documents by post to Autonomous Republic of Crimea, the High Qualification Commission of Judges of Ukraine informs that judges from the ARC may apply to the Commission to obtain copies of the Commission decision of 5 October, 2015 and the opinion of the Commission Member on opening disciplinary proceedings against them. The Commission also informs that consideration of the disciplinary case will be held on 26 October, 2015 at 10 a.m. in the meeting room of the Commission with an address at 9 Mekhanizatoriv str., Kyiv.
